NCLAT defers hearing on Google's Play Store billing policy to July 5

Insolvency appellate tribunal NCLAT on Friday deferred hearing to July 5 on the petitions filed against tech giant Google over its Play Store billing policy.


A two-member National Company Law Appellate Tribunal (NCLAT) bench, after a brief hearing over the petitions, directed listing the matter after summer vacations on July 5.


Indian Broadcasting and Digital Foundation (IBDF), Indian Digital Media Industry Foundation, People Interactive India which operates Shaadi.com, and Mebigo Labs which operates Kuku FM have filed petitions before the NCLAT against Play Store billing policy.


During the proceedings, counsel appearing from app developers requested the bench to pass an order directing status quo till the next date of hearing, though Google had not de-listed them from the Play Store for non-acceptance of policy terms.


They urged the appellate tribunal to ask Google for an undertaking to this effect.


Google’s counsel refused to give an undertaking, however, assured the NCLAT that it will not do so till the next hearing.


On this, the NCLAT bench, comprising Justice Yogesh Khanna and Justice Naresh Salecha, said the app developers may approach the appellate tribunal for an urgent hearing during the summer vacations, if any adversarial steps are taken.


The petitioners have challenged the order passed by the Competition Commission of India (CCI), which had on March 20, 2024 declined to grant any interim relief against Play Store billing policy and restrain Google from collecting fee.

 


On March 20, CCI dismissed four petitions of Indian app companies filed against Google’s new Play Store billing policy to levy an 11 to 26 per cent charge on in-app payments.


The CCI’s decision was challenged by the app companies before the NCLAT.


The Indian-origin app firms had alleged before CCI that Google’s Play Store payment policies are anti-competitive.


However, CCI in its order had made it clear that nothing stated in this order shall be tantamount to a final expression of opinion on the merits of the case, and the Director General will conduct the investigation without being swayed in any manner whatsoever by the observations made herein.


“The commission is of the view that the informants have failed to meet the necessary criteria for grant of interim relief as propounded by the Supreme Court. The informants have not been able to project any higher level of prima facie case warranting a positive direction as sought for by the informants at the interim stage,” CCI had said in its order.


The petitions were seeking the regulator to restrain Google from collecting any fee for transactions involving paid downloads or in-app purchases on apps offering digital products/services.


The order had come after the Competition Commission of India (CCI), on March 15, ordered a probe against Google for alleged discriminatory practices with respect to its Play Store pricing policy after finding a prima facie violation of the competition law.


CCI had then held that the tech giant’s Users Choice Billing (UCB) payments policy was “prima facie” violative of the Competition Act 2002.

Data centres in India to drive 10 mn sq ft real estate demand: Report


The surge will be due to the rising adoption of artificial intelligence (AI), leading to higher power consumption.


The data centre industry in India is set for expansion, requiring an additional 10 million square feet of real estate space and attracting investments totalling $5.7 billion, according to a report on Friday.


Data centre capacity is projected to increase by 791 megawatts (MW) by 2026, according to the real estate consultancy JLL. The surge will be due to the rising adoption of artificial intelligence (AI), leading to higher power consumption.


As AI usage gains pace, the demand for Indian data centres is expected to be in the range of 650-800 MW in 2024-26.


JLL said the increase in computing power and emerging applications will fuel robust demand for the data centre industry shortly. Cloud service providers (CSPs), offering information technology infrastructure for data storage and computing power via the internet, are adjusting their strategies to accommodate AI-driven demand. They are also committing to increased investments to support AI-driven expansion.


“The exponential growth in processing power and data volumes, driven by AI, necessitates the development of new data centres capable of meeting energy, processing, and cooling needs. The anticipated expansion and progression of diverse AI disciplines are projected to create additional demand for data centres, expanding their capacity requirements and advancing their capabilities,” said Rachit Mohan, APAC Lead – Data Centre Leasing and Head – Data Centre Advisory, India, JLL.


The report said that during the second half of 2023, there was a 12 per cent increase in absorption to 81 MW compared to 72 MW during the same period last year. This growth can be attributed to CSPs gaining momentum after a pause in the first half of 2023. In Mumbai, absorption nearly doubled during this period as CSPs renewed their pace of absorption.


“India is poised to be the third-largest economy, with a projected $5 trillion GDP by 2027, with the digital economy contributing around 20 per cent. This digital expansion is anticipated to propel the growth of India’s data centre industry, projected to increase from 853 MW in 2023 to 1,645 MW by 2026. This increase in capacity will require an investment of $5.7 billion and approximately 10 million square feet of real estate,” said Samantak Das, chief economist and head of research & REIS, India, JLL.


There was a lower supply addition of 75 MW during H2 2023 as the available supply from the first half was utilised to meet the demand, resulting in tighter vacancy levels of 5.5 per cent.

Nothing is reportedly working on its next-generation smartphone, the Phone 3. While the smartphone’s name or existence has not been officially confirmed, there is a reason to believe that the phone is in the works. The UK-based consumer technology startup’s CEO, Carl Pei, has posted a smartphone picture on X, formerly Twitter, revealing the redesigned Quick Setting panel of the Nothing OS. The smartphone image appeared on the post is reportedly of the Phone 3.


According to a report by Android Authority, the smartphone featured in Pei’s post on X is Phone 3. To back its claim, the report stated that the company’s previous smartphones, including the recently launched Phone 2a, sports two volume buttons on the left and a power button on the right side. However, the smartphone shown in the post shared by Nothing’s CEO shows an additional button on the right, suggesting that this might be an unreleased smartphone by the company.


The report stated that the smartphone is the company’s next flagship smartphone, the Nothing Phone 3, which is expected to launch in the coming months. It also stated that the additional button on the right side of the frame could have functionality similar to Apple’s Action Button, which debuted on iPhone 15 Pro series smartphones. The button would likely offer customisable functionality, such as for turning the smartphone to silent mode, opening the camera app, and more.


Nothing’s recent announcements of ChatGPT integration into its audio products and NothingOS also opens up the possibility that the new button might offer deeper integration of OpenAI’s artificial intelligence chatbot into the smartphone. The new button could potentially be used to launch ChatGPT voice, similar to how long pressing the power button on Android phones opens up Google’s Assistant.


As of now, not much is known about the Nothing Phone 3. However, it is expected to launch in the month of July, following the launch cycle of previous generation flagship smartphones from the company.

ASUS’ next-generation handheld gaming console, the ROG Ally X, is launching on June 2. While the company has already confirmed a few specification details about the ASUS ROG Ally X such as display size and processor, more details from other sources have surfaced on the web ahead of the launch.


According to a report by The Verge, the upcoming ROG Ally X will feature an 80-watt hour (Wh) battery compared to the 40Wh on its predecessor. The report aligns with the company’s statement that the next-generation model will have more than 40 per cent improvement in battery capacity. As per the report, despite featuring a significantly bigger battery, the handheld gaming console will gain an additional 70g weight. It is also said that the total thickness of the device has increased from 32mm on the first generation model to 36.9mm on the upcoming Ally X.


ASUS has managed to keep the increase in weight and thickness in check likely due to smaller and thinner fan design, which is also expected to increase the airflow by up to 10 per cent – as per the report.


The report also stated that the upcoming ASUS ROG Ally X will get a new variant featuring 24GB RAM, which will also be a faster LPDDR5 type. Additionally, the ASUS ROG Ally X would get another USB Type-C port, which will replace the eGPU port that exists on the current generation model.


Earlier this month, during the announcement of the ASUS ROG Ally X, the company confirmed that the handheld gaming console will continue on the Windows 11 platform and feature the same AMD Z1 Extreme chipset that currently powers the ROG Ally. Additionally, the upcoming model will sport a 7-inch LCD display of 120Hz refresh rate and will be offered in black colour, different from the current model that only comes in white.

Apple fixes this 'rare issue' on iPhones with iOS 17.5.1 software update


Apple has released iOS 17.5.1 software update, addressing an issue that caused deleted images to resurface for users after they updated their iPhone to iOS 17.5. In the release note for the new update, Apple said that the “rare issue” was caused as a few deleted pictures “experienced database corruption”, making them reaper in the Photos library.


After the iOS 17.5 release, multiple iPhone users reported that updating their iPhones to the latest iOS version brings back the deleted pictures on iPhone’s photos gallery. Some also reported that older pictures are being shown in the “Recents” album.


Apple in a statement to 9To5Mac confirmed that the problem was not linked to iCloud Photos, rather due to the corrupt database entry that was stored on the device locally. Apple said that the photos that were not entirely deleted were on the device’s storage. However, the photos could have moved from one device to another while transferring data. The pictures could have also moved while restoring data from an iCloud backup but there was no involvement of iCloud Photos.


Apple said that this was a rare issue and affected a “small number of users” only for a few pictures. The company also said that Apple does not have access to a user’s photos or videos.


In their statement, Apple discarded the claim of a user that posted on social media platform Reddit, stating that their pictures resurfaced even though the device was erased and sold to another user. Apple said that these claims were false and all files and content are permanently deleted after the device has been completely erased.

X to make likes on posts private to help users protect their 'public image'



X, formerly known as Twitter, will soon make likes private in order to help users protect their public image. Haofei Wang, Director of Engineering at X, has confirmed the move stating public likes are incentivising wrong behaviour on the platform. According to Wang, “many people feel discouraged from liking content that might be “edgy” in fear of retaliation from trolls, or to protect their public image”.


Wang encouraged users to like the posts without worrying who might see it. He concluded his post with a reminder that “For You” section algorithms get better by learning from the users’ activity on the platform, including posts they like.


Enrique Barragan, senior software engineer took to X to clarify that users will be able to see the number of posts and replies on their own post but likes of users will not be visible on other posts.

Elon Musk had earlier revealed his plans for hiding likes and number of reposts. For now, users will have the option of hiding their likes on a post and eventually public likes might be gone completely. Earlier available to only paid subscribers, the feature will soon be available for all and will make likes automatically private for users on the social media site. Although it is not clear if view count will still be visible.


As likes influence the algorithm and one is shown similar posts, this feature will enable X to show you content similar to liked posts and allow a more personalized timeline.  This feature arrives a few days after Twitter officially moved over to ‘X’ domain.
