OpenAI slams Elon Musk, calls his claims 'incoherent' in court filing

OpenAI lambasted Elon Musk’s allegations against it, saying in a court filing that the billionaire entrepreneur’s claims “rest on convoluted — often incoherent — factual premises.” 

 


The strongly worded filing is the company’s first legal response to Musk’s February lawsuit against the company, Chief Executive Officer Sam Altman and President Greg Brockman. Musk alleged the startup had strayed from its mission to build responsible artificial intelligence and that it had become beholden to Microsoft Corp., its largest investor. 


In the filing, OpenAI stresses that it did not violate its agreement with Musk because “there is no founding agreement, or any agreement at all with Musk, as the complaint itself makes clear.” OpenAI also denied Musk’s claims in a memo to staff and a blog post last week.


“The relief Musk seeks is as extraordinary as his claims are contrived,” OpenAI said in its filing in San Francisco state court. “Musk requests an order compelling OpenAI to reorganise and distribute its technology in accordance with the terms of his fictitious contract.”


OpenAI and Musk have been engaged in a well publicised battle since well before the court case. Musk was an early backer of the startup and part of its founding team, before he had a falling out with the company. Musk has criticised OpenAI for its commercialisation strategy and its close relationship with Microsoft. 


In its blog post, OpenAI said that Musk had previously pushed to make the company part of Tesla Inc., his car company. It also said in the filing that Musk was in favor of OpenAI operating as a for-profit company, but only if he controlled it. “Seeing the remarkable technological advances OpenAI has achieved, Musk now wants that success for himself,” the company’s lawyers wrote.


Musk and OpenAI did not immediately respond to requests for comment.


The dispute between two of tech’s biggest players touches on core issues of AI safety and accessibility, and has spilled over into the larger startup world. On Monday, billionaire venture capitalist and OpenAI investor Vinod Khosla told Bloomberg TV that Musk could not sue his way to artificial general intelligence.


OpenAI also argues in the filing that if pretrial fact-finding and information sharing known as discovery begins in the case, Musk would use the suit to get access to OpenAI’s “proprietary records and technology,” and warned that demands for discovery “would need to be carefully policed.”


OpenAI also asked that the court designate the suit a “complex case,” which under California rules is a meant to avoid making the case unnecessarily burdensome for the court and the parties involved. Cases are typically deemed complex and assigned to specially designated judges when they involve complicated and technical issues, as well as multiple parties and numerous claims.

Salesforce is planning to set up a unit to focus on the public sector in India in the next few months, reflecting the surge in technology adoption by government organisations within the country. 

 


The company is looking to tap into various opportunities in the government sector in areas such as postal services, education, subsidies to the citizens and healthcare services. For this, the firm plans to engage with various state governments and the Centre.

 


“We may come up with an announcement in the next few months regarding the setting up of our public sector unit,” said Arundhati Bhattacharya, chairperson and chief executive officer, Salesforce India. 

 


Bhattacharya said Salesforce has more than 500 use cases in the government sector globally. The firm has strengthened its presence in India with a 35 per cent year-on-year growth in new business driving efficiency, productivity and success for customers across industries as per the latest earning call, announcing the FY24 results.

 


“It’s been a year of phenomenal growth and India continues to be a bright spot for Salesforce globally,” said Bhattacharya. “This is a golden era of technology adoption in the country and we are excited to be a part of this digital transformation journey. We continue to focus on empowering businesses to harness the power of artificial intelligence.”

Flat white coffee, a famous beverage all over the planet, is the subject of Google Doodle today. It was March 11, 2011 when the ‘flat white’ was added to the Oxford English Word Dictionary as Google remembered the event with an animated doodle. Google stated on its site, “This animated doodle celebrates flat white, a popular espresso-based beverage which originated in Australia and New Zealand”.


It is a widespread belief that the ‘flat white’ started in Australia and New Zealand during the 1980s, and it started appearing in the menus in both Sydney and Auckland around that period.


History of flat white


March 11 is celebrated as the day when flat white was added to the Oxford English Dictionary, in 2011. Flat white which is a favourite espresso drink of steamed milk poured over a dose of coffee is estimated to have been first served in Australia and New Zealand. It is believed that the beverage originally showed up on the menus of Sydney and Auckland during the 1980s.


Flat white made: The process 


A flat white consists of an espresso finished off with steamed milk and a thin layer of micro-foam froth and is generally served in a ceramic cup. Flat whites are famous among those coffee connoisseurs who need less froth in their drink as flat white is “flatter” than a cappuccino or latte. In numerous bistros across Australia and New Zealand, customers are usually charmed into having the beverage by baristas who flaunt their abilities and make lovely fine art while setting up the beverage.

Throughout the years, espresso culture has changed a great deal and so have the ways of preparing the ‘flat white.’ It was customary to prepare flat white with with whole milk, however, these days it’s generally expected to see Aussies and Kiwis ordering it with plant-based milk including oat milk. 


The flat white is acquiring popularity and is turning into a favourite since its spread far across the world. It has come to please numerous and has turned into a staple drink in numerous countries. Elon Musk said on Monday his artificial intelligence startup xAI would open-source its ChatGPT challenger “Grok” this week, days after he sued OpenAI for abandoning its original mission in favor of a for-profit model.


The billionaire has warned on several occasions against the use of technology for profit by big technology companies such as Google. He filed the lawsuit against Microsoft-backed OpenAI, which he co-founded in 2015 but left three years later, last week.


“This week, @xAI will open source Grok,” Musk said in a post on X, the social media firm he owns.

The move could give the public free access to experiment with the code behind the technology and aligns xAI with firms such as Meta and France’s Mistral, both of which have open-source AI models.


Google has also released an AI model called Gemma that outside developers can potentially fashion according to their needs.


Tech investors including OpenAI backer Vinod Khosla and Marc Andreessen, co-founder of venture capital firm Andreessen Horowitz, have been debating about open-sourcing in AI since Musk filed the lawsuit against the ChatGPT maker.


While open-sourcing technology can help speed up innovations, some experts have warned that open-source AI models could be used by terrorists to create chemical weapons or even develop a conscious super-intelligence beyond human control.


Musk said at Britain’s AI Safety Summit last year that he wanted to establish a “third-party referee” that could oversee firms developing AI and sound the alarm if they have concerns.


Seeking an alternative to OpenAI and Google, Musk launched xAI last year to create what he said would be a “maximum truth-seeking AI”. In December, the startup rolled out Grok for Premium+ subscribers of X.


In a podcast episode with computer scientist and podcaster Lex Fridman, Musk suggested in November that he favored the concept of open-source AI.


“The name, the open in open AI, is supposed to mean open source, and it was created as a nonprofit open source. And now it is a closed source for maximum profit,” Musk had said.
