Delhi High Court issues directives for sale of refurbished hard disk drives

Delhi High Court on Thursday directed entities selling refurbished hard disk drives (HDDs) to comply with specific disclosure requirements on their promotional materials, including websites, e-commerce listings, brochures, and manuals, according to a report by Bar and Bench.


The High Court’s decision came in response to a series of lawsuits filed by Seagate Technology LLC and Western Digital Technologies Inc against several companies selling refurbished HDDs.


Lawsuits filed by tech companies


The defendants in the case included Daichi International, Consistent Infosystems Pvt Ltd, Geonix International Pvt Ltd, and Cubicor Information Systems Pvt Ltd. Seagate and Western Digital argued that HDDs manufactured by them become unserviceable after a certain period but still retain some functionality. These end-of-life HDDs are often refurbished and sold to consumers by various entities, particularly after being imported into India.


According to the plaintiffs, these used HDDs are imported by various importers, refurbished by removing the original brand marks, repackaged under different brand names, and sold with an extended two-year warranty.


Seagate and Western Digital contended that selling these HDDs as refurbished products without their original branding amounted to impairment, which is not allowed under Sections 30(3) and 30(4) of the Trade Marks Act, 1999.


Delhi High Court ruling


However, the High Court ruled that Seagate and Western Digital failed to demonstrate any rule, regulation, or policy that prohibits the import of discarded HDDs or equipment into India.


Presiding over the case, Justice Anish Dayal emphasised that if the traders who refurbish fully disclose any alterations or removal of original marks on HDDs and clarify that the product differs from the original, consumers are sufficiently informed about their purchase.


Court issues guidelines for sale of refurbished hard drives:


1) Name of original manufacturer must be stated: Packaging of refurbished HDDs must clearly state the name of the original manufacturer in a way that does not mislead customers into believing they are purchasing a new product.


2) Packaging must include a clear statement that there is no warranty: The Court specified that packaging must include a clear statement indicating that there is no manufacturer’s warranty or service on the refurbished product. Instead, it should prominently display that any warranty or service is provided by the refurbishing entity. This statement must also include customer care details and contact information for the respective businesses that refurbish gadgets.


3) Features should be clearly stated on the package: Packaging must accurately and truthfully describe the features and purpose of the refurbished product. It should avoid any misleading, ambiguous, or deceptive statements that could misinform consumers about the product’s capabilities or intended use.

OpenAI has temporarily stopped the use of the ‘Sky’ voice in its ChatGPT model, following allegations from Hollywood actress Scarlett Johansson that the AI’s voice bore resemblance to hers without her consent. The controversy arose after CEO Sam Altman was accused of seeking to license Johansson’s voice, a request she declined.


In response to the allegations, Altman issued a statement stating that OpenAI had no intention of replicating Johansson’s voice. He clarified that a voice actor had already been selected before any contact was made with Johansson.


A report published in The Washington Post shed light on the process behind the creation of the AI voices. According to the report, OpenAI had issued a casting call seeking non-union actors aged between 25 and 45 for a confidential project aimed at imbuing ChatGPT with a human-like voice.


Documents and recordings cited in the report indicated that an actress had been hired months prior to Altman reaching out to Johansson. The chosen actress, reportedly not Scarlett Johansson, adopted the pseudonym ‘Sky’ to convey a soothing and refreshing tone, said the report.


Joanne Jang, product lead at OpenAI responsible for overseeing AI model behaviour, said the company meticulously selected actors enthusiastic about the project. Prospective actors were required to showcase a sample AI version of their voice to exemplify how realistic the technology could sound.


Reacting to the development, the voice artist involved in the project said, “While that was unknown and honestly kinda scary territory for me as a conventional voice over actor, it is an inevitable step toward the wave of the future.”


What really happened?


On May 19, OpenAI introduced five unique voice avatars for its ChatGPT platform, namely Breeze, Cove, Ember, Juniper, and Sky. The company stated that these voices were crafted in collaboration with professional voice actors. However, some listeners noted similarities between the Sky voice and that of Scarlett Johansson.


According to a report by Deadline, Johansson issued a statement where she revealed Altman made him an offer to become the voice of ChatGPT 4.0. 


“He told me that he felt that by voicing the system, I could bridge the gap between tech companies and creatives and help consumers to feel comfortable with the seismic shift concerning humans and AI. He said he felt that my voice would be comforting to people,” Johansson said in the statement. Altman was perhaps right but the actor saw it differently and declined the offer “for personal reasons”, Johansson said.


Yet, nine months later Sky sounded very much like the Black Widow star. “When I heard the released demo, I was shocked, angered and in disbelief that Altman would pursue a voice that sounded so eerily similar to mine that my closest friends and news outlets could not tell the difference,” she added.


What made it worse for Johansson was when he tweeted ‘Her’ which was in reference to the actress’ movie. Altman, according to the actress, contacted her agent two days before the ChatGPT 4.0 demo was released but before the two parties could connect, the system was “out there”.


What did the actress do?


Johansson hired legal counsel and wrote two letters to Altman and his company OpenAI, seeking clarification on the development process of the Sky voice. 


“Consequently, OpenAI reluctantly agreed to take down the ‘Sky’ voice,” she said, adding that when deepfake is such a big issue, it is pertinent to protect “our own likeness, our own work, our own identities”.


What did OpenAI say?


OpenAI categorically denied that it imitated Johansson’s voice. “We believe that AI voices should not deliberately mimic a celebrity’s distinctive voice — Sky’s voice is not an imitation of Scarlett Johansson but belongs to a different professional actress using her own natural speaking voice,” it said. 


Meanwhile, the voice has been taken down as of now and Johansson isn’t pursuing further legal action.

South Korean automobile maker Kia has unveiled the EV3 compact SUV. Among the headline features is an artificial intelligence-powered voice assistant, a first in the company’s electric vehicle fleet. The AI assistant is reportedly powered by ChatGPT, the generative AI-chatbot from Microsoft-backed OpenAI.


In a statement to TechCrunch, Kia’s head of customer experience design, Pablo Martinez said that the large language model (LLM) behind the company’s AI assistant is ChatGPT from OpenAI. However, it has been “heavily modified”, he said.


The AI-powered voice assistant on the EV3 SUV is an enhanced version of its voice assistant technology, which debuted on the company’s compact sedan Kia K4. The voice assistant allowed customers new ways to interact with and control the vehicle’s built-in features. With the integration of generative AI into the technology, Kia’s voice assistant gains the capability of holding a more natural conversation with the user.


With AI voice assistant, Kia said, users can leverage the generative properties to plan trips, control the vehicle’s entertainment system, and search for information. Kia said that generative AI integration into the voice assistant will start with the EV3 model and will later roll out to the company’s other EVs.


Kia EV3 featuring its ChatGPT powered AI assistant will launch in the company’s home country in July followed by Europe in the “second half of the year.” TechCrunch reported that Kia is expected to expand sales of the EV3 model into other regions as well, however, there has been no official confirmation by the company.

Artificial intelligence (AI) is rapidly evolving, transforming modern life and integrating humanising tools. However, Chief Executive of Microsoft Satya Nadella has a different take on this. Referring to the current practice of attributing human qualities to machines, Nadella told Bloomberg Television, “I don’t like anthropomorphising AI. I sort of believe it’s a tool.”

Nadella said, he even dislikes the term “artificial intelligence” itself, coined in the 1950s. “I think one of the most unfortunate names is ‘artificial intelligence’. I wish we had called it ‘different intelligence’,” Microsoft CEO said.


“Because I have my intelligence, I don’t need any artificial intelligence,” he explained.


Last week, a Google executive discussed with Bloomberg the company’s emphasis on crafting AI that is “super helpful and super useful”, despite acknowledging the technical feasibility of developing tools that “show emotion”.


OpenAI’s AI assistant


OpenAI, however, has taken a different approach. In their recent demo, they showcased a playful voice AI assistant with the ability to comprehend and convey emotions. During the presentation, there were instances where the AI engaged in playful banter with the presenter, prompting comparisons to the movie ‘Her’.


This similarity was amplified by a voice option that some users perceived as resembling Scarlett Johansson, the film’s lead actress. Johansson criticised OpenAI for using a voice in its new ChatGPT product that closely resembled her own. She said she had declined an offer from OpenAI to voice their AI system last year for “personal reasons”. She expressed “shock” and “anger” upon hearing the voice, which she said was so similar to hers that even her closest friends and news outlets couldn’t tell the difference.


As AI soars, there is an inherent inclination to anthropomorphise it, as individuals seek to explain the mathematics, algorithms, and code, saying that AI “learns”. This has led to technology companies intensifying their efforts to engage in real-time conversations.


However, in the interview, Nadella said users need to recognise that the capabilities exhibited by AI software do not equate to human intelligence. “It has got intelligence, if you want to give it that moniker, but it’s not the same intelligence that I have,” he said.

Samsung could continue with the Qualcomm processor for the Galaxy Fold and Galaxy Flip foldable devices in 2024. This is in contradiction to earlier reports stating Samsung would use its Exynos chip in its next-generation foldable in a few regions, similar to the Galaxy S24 and Galaxy S24 Plus models. However, the Galaxy Z Fold 6 and Galaxy Z Flip 6 are reported to be powered by Qualcomm Snapdragon 8 Gen 3 globally.


Samsung has often resorted to dual chip strategy with its flagship products. For example, the Galaxy S24 and S24 Plus smartphones were launched with the Qualcomm Snapdragon 8 Gen 3 in select markets, including the US, but the same smartphones featured Exynos chips in select regions, including India. Earlier, it was reported that Samsung might opt a similar strategy for its upcoming foldable smartphone.


The previous generation Galaxy Z Fold 5 and Flip 5 were also powered by the top of the line Qualcomm chips everywhere it was available and the next generation models are expected to do the same.


Although the Exynos-powered devices are generally considered equal to Qualcomm chips-powered devices, the former chip often gets criticised for performance and thermals in comparisons. As per the report, the Galaxy Z-series has been designed around the Qualcomm processors since the first generation model, and adding another processor option might further increase the cost of the foldable smartphone series which is already considered to be expensive.


The report also stated that Samsung might offer multiple chip options for Galaxy Z-series foldable devices once it closes the gap to Galaxy S-series flagships in terms of shipments.


Next generation Galaxy Z Fold and Z Flip are expected to launch alongside the upcoming Galaxy Ring and Galaxy Watch 7 series at the next Galaxy Unpacked event – possibly sometime in July.
