US Judge cancels class-action lawsuit won by users against Google

Google will likely be off the hook for paying damages to 21 million users who claim in an antitrust lawsuit they were overcharged in the company’s app marketplace as a federal judge retracted a ruling that gave them class-action status.

 


The ruling, which is yet to be finalized, would dramatically reduce potential damages facing Alphabet Inc. over claims that Google Play abuses its control over Android mobile applications. The consumer dispute is part of a sweeping antitrust fight that also includes complaints filed by attorneys general of almost three dozen states, Epic Games Inc. and Match Group Inc. over Google Play store policies.


US District Judge James Donato in San Francisco canceled his class-status order after he concluded that testimony by an expert for consumer plaintiffs “is based on assumptions about the Play Store apps that are not supported by the evidence.”


“We appreciate the court’s careful consideration of this issue,” a Google spokesperson said. “We look forward to making our case at trial.”


Lawyers representing consumers didn’t immediately respond to a request for comment.


The judge said that because the issue of class-action status is pending before a federal appeals court, he can’t unilaterally rescind his November order that grouped together consumers from 17 states who aren’t represented in the 2021 suit brought against Google by state attorneys general.


Donato asked lawyers for the consumer plaintiffs and Google to meet and figure out a way to resolve the appeals issue before a hearing set for Sept 7. 


Google still has to face a Nov. 6 trial over antitrust claims by Epic and the attorneys general who are representing almost 70 million consumers.


The consumers claim Google inflated Android app prices by taking, with some exceptions, a 30% cut of sales on Google Play. State attorneys general said in their 2021 complaint that Google used anticompetitive tactics to block competition and ensure that developers have no choice but to go through the Google Play store to reach users. It then collects an “extravagant” commission of up to 30% on app purchases, the states said.

OpenAI launched a corporate version of ChatGPT with added features and privacy safeguards, the startup’s most significant effort yet to attract a broad mix of business customers and boost revenue from its best-known product.




As with consumer versions of the company’s artificial intelligence-powered chatbot, users can type in a prompt and receive a written response from ChatGPT Enterprise.  The new tool includes unlimited use of OpenAI’s most powerful generative AI model, GPT-4, as well as data encryption and a guarantee that the startup won’t use data from customers to develop its technology. The offering also offers the ability to type in much longer prompts.


The rollout of ChatGPT Enterprise is a move forward in OpenAI’s plans to make money from its ubiquitous chatbot, which is enormously popular but very expensive to operate because robust AI models require lots of computing power. The San Francisco-based startup has already taken some steps toward generating revenue from ChatGPT, such as by selling a premium subscription and offering companies paid access to its application programming interface, which developers can use to add the chatbot to other apps.


Brad Lightcap, OpenAI’s chief operating officer, declined to provide specific details for how much ChatGPT Enterprise will cost, noting it can vary based on the needs of each business. Lightcap said the company “can work with everyone to figure out the best plan for them.”


“We’ve really tried to build the best version of ChatGPT,” Lightcap said in an interview. “That was the mandate for the team: How do we build something that’s the ultimate productivity enhancer?’”


OpenAI worked with more than 20 companies, from small startups to larger firms, that had a range of experience with AI to test ChatGPT Enterprise, Lightcap said. Existing users include beauty company Estée Lauder Cos., design software maker Canva Inc. and automation platform Zapier Inc. Early customers of the product are tapping it for tasks like coding, helping with creative work and answering business questions, according to OpenAI. 


ChatGPT has been used by more than 80% of Fortune 500 companies since it was rolled out in November, OpenAI said. But even as a growing number of organizations have found ways to use ChatGPT for coding and brainstorming, some businesses have purposely stayed away from the chatbot and a growing number of competing AI tools because of concerns about the security and privacy of company and customer data. 


In an effort to address those concerns, OpenAI said it won’t train its AI models — the process of feeding new content to generative AI technology to increase its knowledge base — with prompts or data from companies using ChatGPT Enterprise. The startup now trains its models on the written prompts users feed ChatGPT online or through its mobile apps, unless users opt to withhold them, though its software filters out personally identifiable information that comes in from users. It doesn’t train its AI on data sent via its API.


Some companies have also worried about the propensity of large language models, the technology underpinning ChatGPT, to make things up. Lightcap pointed out that GPT-4, first unveiled in March, is less prone to fabricating results than the previous AI model.


“Whether you’re building on our API or using ChatGPT in a personal capacity as a consumer or using it in a work context as an enterprise, we want to serve the highest-quality model, the best models, in all of those places,” Lightcap said.

The Indian government should take lead and set up a “compute infrastructure” for the development of artificial intelligence in the manner it did for super computing and communications, IBM Chairman and CEO Arvind Krishna said on Monday.


Krishna said every country should build sovereign capability in artificial intelligence and the government should provide a base for technologies that are nascent and have high risk appetite.


“I am a firm believer that every country ought to have some sovereign capability on artificial intelligence because you want to use it for purposes which the rest of the world may not want to invest in. That means you need capability on compute and storage and data sets and I think it is for the nation to provide,” Krishna told reporters.


He said that only two large economies of the world have compute infrastructure for AI and some countries have started plans for setting it up.


“India is largely a services economy in tech. But they have to do the investment. I think you can become proficient at hundreds of millions of US dollars. Hundreds of millions of US dollars is well within the capacity of India,” Krishna said.


Building AI technology or AI engines call for investment in high-speed computer chips like graphical processing units or application-specific chips.


Recently, Chinese companies ordered USD 5 billion worth of chipsets from Nvidia to build generative artificial intelligence systems.


Companies in the US are also investing heavily in high-end chipsets to build AI capability.


Microsoft provided OpenAI LP with a USD 1-billion investment in 2019 and a USD 10-billion investment in 2023.


IBM alone invested USD 6.5 billion in research, development and engineering to innovate in the field of AI, hybrid cloud and emerging areas such as quantum in 2022.


In July 2023 quarter, Nvidia reported over 100 per cent jump in revenue at USD 13.5 billion and over nine-fold jump in its net income mainly on demand for chipsets for AI.


“Investment from the government should be to set up, lets say, national AI computing centres. They should set up an infrastructure which could be under one of the existing bodies or maybe this new body. The same India did for computing, which has helped in lots of things,” Krishna said.


The IBM chief said he has had a discussion with the minister of state Rajeev Chandrasekhar and sees there is receptiveness to the idea of setting up such infrastructure.


“I think in order to take advantage of the opportunity, and India becomes a source of deployment on these things as well as use it internally for government and citizen services then India has to have some infrastructure,” Krishna said.

The Vivo V29e sports a dual-camera setup on the back, featuring a 64-megapixel main camera


Chinese electronics manufacturer Vivo launched the V29e smartphone in India on August 28. According to Vivo, the smartphone is slimmest in its segment at 7.5mm and boasts a one-piece frame design. Weighing at 180g, the smartphone sports a 6.78-inch two-side curved display of 120Hz and a peak brightness that can go up to 1300nits.


The Vivo V29e sports a dual-camera setup on the back, featuring a 64-megapixel main camera with optical image stabilisation and an 8MP ultra-wide-angle secondary camera. On the front, the smartphone features a 50MP selfie camera that Vivo said has the highest pixel count in the segment. The V29e gets various camera modes, including night mode, night selfie mode and vlog movie mode.


The V29e is powered by a 5,000mAh battery, supported by 44W FlashCharge. The smartphone is powered by Qualcomm Snapdragon 695 processor, paired with 8GB RAM and up to 256GB storage. The smartphone features Extended RAM 3.0, which Vivo said would allow users to allocate up to 8GB of storage space for RAM functions. The V29e boots FunTouch OS 13, which is Vivo’s custom interface based on Android 13 operating system.


The Vivo V29e is priced at Rs 26,999 for the 128 GB variant and Rs 28,999 for the 256GB model. It is offered in artistic red and artistic blue colours. Vivo said the phone will be available for pre-orders from August 28, while the device will be available for purchase from September 7 on Flipkart and Vivo e-store.

Amid increasing scrutiny from regulators, over-the-top (OTT) platforms have reaffirmed their commitment to self-regulation in a letter to the Centre, according to a report by Mint.




The Internet and Mobile Association of India and the Indian Digital Media Industry Foundation submitted the letter on behalf of the industry, outlining their long-term goals and responsibilities, such as implementing age-based classifications for shows and films and fortifying self-regulatory organisations.




Industry experts have indicated that recent shows like Kohrra and Rana Naidu have raised concerns in certain circles.


These video-streaming platforms are also apprehensive about a consultation paper proposed by the Telecom Regulatory Authority of India (Trai) to regulate OTT services. Furthermore, it remains unclear whether amendments to the Cinematograph (Amendment) Bill necessitate a re-evaluation of age classifications.

The legal head of one streaming service noted that there has been a surge in complaints regarding content due to increased OTT consumption following the Covid-19 pandemic. The objective is to strike a balance between creative freedom and sensitivity. There are also concerns surrounding the Trai consultation paper specifically for technology applications.




Moreover, the platforms remain uncertain whether films shown on secondary platforms require approval from a censor board.




In the wake of the Tandav incident, the legal head mentioned that platforms are exercising caution with the intent to avoid offending any sentiments.

 

Subhash Bhutoria, founder and managing partner of Law SB, commented that OTT platforms have reiterated the terms set out in the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. He mentioned that monitoring the enormous volume of content on these platforms is a significant challenge that requires substantial time and resources, particularly when over 57 OTT platforms are operational in India.

An executive from an OTT platform also suggested that many platforms could improve age-gating and access controls.

According to Qualcomm, the new Snapdragon G-series lineup is built to meet the performance and feature demands of dedicated gaming devices.
