Arvind Kejriwal Arrested By Enforcement Directorate In Liquor Policy Case


The AAP chief was questioned at his residence before his arrest

New Delhi:

Delhi Chief Minister and Aam Aadmi Party chief Arvind Kejriwal has been arrested by the Enforcement Directorate in the alleged liquor policy scam, unleashing waves of protest by thousands of the party workers and supporters and strident condemnation from the leaders of the Opposition.  The arrest of a serving Chief Minister — an unprecedented, seismic development in national politics — comes just weeks ahead of the Lok Sabha election. The Aam Aadmi Party has knocked at the doors of the Supreme Court. The hearing is due tomorrow. The party has also said that Mr Kejriwal will continue to discharge his duties from jail – a prospect that may create a constitutional crisis, legal experts have said.

The central agency, which was investigating the money laundering angle in the case, turned up at Mr Kejriwal’s house in the evening. After a search and questioning session, he was arrested around 9 pm and taken to the ED office in Delhi two hours later. He will remain in the ED lock-up tonight after a medical check-up from the RML hospital, sources said.

Speaking from outside the Chief Minister’s official residence on Thursday, Delhi minister Atishi said Mr Kejriwal’s arrest is a “conspiracy by the BJP and Prime Minister Narendra Modi”.

“Mr Kejriwal is not just a man, he is an idea. If you think arresting one Kejriwal can finish off the idea, you are wrong. Mr Kejriwal is, was and will remain the Delhi chief minister. We have said from the beginning that he will run the government from jail if need be. He has not been convicted… No law stops him from doing so,” she said in Hindi.

At a post-midnight press conference, AAP said it was called a nationwide protest against the BJP on Friday. In Delhi, the protest will take place outside the BJP headquarters. “All the INDIA bloc parties stand with us,’ said Ms Atishi, who is second to Mr Kejriwal in the Delhi government.

The arrest too place after Mr Kejriwal skipped the ninth summons for questioning by the ED earlier on Thursday. Later in the day, the Delhi High Court refused to grant him protection from arrest.

An ED team, comprising 12 officials and led by Additional Director Kapil Raj — the officer who arrested former Jharkhand Chief Minister Hemant Soren in January – had reached Mr Kejriwal’s residence with a search warrant. His and his wife’s phones were confiscated and data was transferred from two tablets and a laptop at his home.

As the ED officials carried out their questioning inside the residence, Delhi Police and Rapid Action Force personnel as well as CRPF teams were deployed outside. Prohibitory orders were imposed in the area outside the residence and several AAP workers, who had gathered to protest Mr Kejriwal’s arrest, were detained.

K Kavitha Link?

The Delhi chief minister’s arrest comes less than a week after BRS leader K Kavitha was taken into custody in the liquor policy case. After her arrest, Mr Kejriwal was, for the first time, named as a conspirator in the case.

Ever since the first summons was issued by the Enforcement Directorate in October last year and he was asked to appear on November 2, there has been intense speculation that the Delhi chief minister would be arrested by the agency.

Former Delhi deputy chief minister Manish Sisodia was put behind bars in connection with the case in February last year, and AAP Rajya Sabha MP Sanjay Singh was taken into custody in October.

Mr Kejriwal has repeatedly said that there was no scam in the Delhi liquor policy and the ED, which he claims is controlled by the BJP, is out to arrest him. The AAP and many other opposition parties have accused the BJP of misusing central agencies against their leaders. The harassment of opposition leaders, they have claimed, has increased in the run-up to the Lok Sabha elections, which will begin on April 19.

The AAP’s allies in the INDIA bloc, including the Trinamool Congress and the Congress have also condemned the arrest. “Targeting Delhi Chief Minister Shri Arvind Kejriwal in this manner due to elections is completely wrong and unconstitutional. Lowering the level of politics in this manner suits neither the Prime Minister nor his government,” senior Congress leader Priyanka Gandhi Vadra posted on X. 

Earlier on Thursday, the Delhi High Court had declined to give protection from arrest to Mr Kejriwal in the liquor policy case, but had asked the ED to file a reply to his petition. Listing the matter for the next hearing on April 22, a Bench of Justices Suresh Kumar Kait and Manoj Jain said, “We have heard both sides, and we are not inclined at this stage (to grant protection). The respondent (ED) is at liberty to file a reply.”

‘Conspirator’

In a press note released on Sunday, the Enforcement Directorate had called the AAP chief a conspirator in the alleged liquor policy scam.

“ED investigation revealed that Ms K Kavitha along with others conspired with the top leaders of AAP including Arvind Kejriwal and Manish Sisodia for getting favours in the Delhi Excise policy formulation and implementation. In exchange of these favours, she was involved in paying Rs 100 Crore to the leaders of AAP,” the press note said.

“By the acts of corruption and conspiracy in the formulation and implementation of Delhi Excise Policy 2021-22, a continuous stream of illegal funds in the form of kickback, from the wholesalers was generated for the AAP. Further, Smt K Kavitha and her associates were to recover the proceeds of crime paid in advance to AAP and to further generate profits/proceeds of crime from this entire conspiracy,” it added.

The Case 

Under the liquor policy, introduced in November 2021, the government withdrew from retail sale of liquor and allowed private licensees to run stores. In July 2022, Delhi Chief Secretary Naresh Kumar flagged gross violations in the policy and alleged “undue benefits” to liquor licensees. The policy was scrapped in September that year.

The CBI has alleged that liquor companies were involved in framing the excise policy, which would have earned them a 12% profit.on the wholesale side. It said a liquor lobby dubbed the “South Group” – of which Ms Kavitha was allegedly a member – had paid kickbacks, part of which were routed to public servants. The Enforcement Directorate has alleged laundering of the kickbacks.

The BJP has claimed that the proceeds of the alleged scam were used by the AAP to fund its campaign for the Gujarat Assembly polls in 2022, in which it got 12.91% of the votes and established itself as a national party.

Acharya Balkrishna, managing director of Patanjali Ayurved and an aide of Yoga guru Ramdev, has apologised to the Supreme Court for the company’s misleading claims about its products and their medicinal efficacy.

The affidavit was filed yesterday, a day after the court came down heavily on Patanjali Ayurved for not responding to a contempt notice over misleading advertisements. The bench of Justice Hima Kohli and Justice Ahsanuddin Amanullah had asked Balkrishna and Ramdev to appear in court on April 2.

In an affidavit filed in the court, Mr Balkrishna has said he has the highest regards for the rule of law. Extending an “unqualified apology”, he said the company will “ensure that such advertisements are not issued in the future”.

Mr Balkrishna clarified that the company’s “intention is only to exhort the citizens of this country to lead a healthier life by consuming products” of Patanjali, including those “for lifestyle ailments through the use age old literature and materials supplementing and backed by ayurvedic research”.

He also said that provisions of the Drugs and Magic Remedies (Objectionable Advertisements) Act, which prohibits advertisements of magic cure claims, is “archaic” and the last changes in the legislation were made when “scientific evidence in Ayurveda research were lacking”. Patanjali, the affidavit said, now has “evidence-based scientific data with clinical research

conducted in Ayurveda, which would demonstrate the advances made through scientific research in the context of diseases mentioned in the said schedule”.

“In light of the same it is humbly submitted that the Deponent’s only quest is for a better and healthier life for each and every citizen and to reduce the burden on the countries healthcare infrastructure by providing holistic, evidence based solutions for lifestyle related medical complications through the usage of age old traditional approach of Ayurveda and Yoga (sic),” it added.

Founded in 2006 by Mr Ramdev and Mr Balkrishna, Patanjali Ayurved is a multinational conglomerate that manufactures a long list of products, ranging from ayurvedic medicine to cosmetics to food items.

The conglomerate has run into trouble over misleading advertisements about the efficacy of their products.

On Tuesday, the Supreme Court came down heavily on Patanjali, citing its failure to respond to a notice for contempt proceedings. The court directed Ramdev and Balkrishna to appear before it. It also noted that Patanjali Ayurved’s advertisements were in the teeth of an undertaking given to the court last year.

On November 21 last year, Patanjali’s counsel had assured the court that “henceforth there shall not be any violation of any law(s), especially relating to advertising or branding of products manufactured and marketed by it and, further, that no casual statements claiming medicinal efficacy or against any system of medicine will be released to the media in any form”.

The Supreme Court is hearing a petition by the Indian Medical Association (IMA) that alleged a smear campaign by Ramdev against the Covid vaccination drive and modern medicine.

The government has opposed any stay on the law to appoint election commissioners, arguing that any challenges to the legislation are politically motivated and “created only on basis of unsupported and pernicious statements”. The government also pointed out challenges to the Chief Election Commissioners Act did not question credentials of persons appointed to the Election Commission.

Responding to the petitioners, the government on Wednesday underlined the point that no objection had been raised about the competence or eligibility of either of the two new appointees. “Instead, a political controversy is sought to be created… only on the basis of bare, unsupported, and pernicious statements about vague and unspecified motives…” the government said.

The government also said the petitioners had failed to submit objections about the qualification of any candidate to hold a Constitutional post, and that, on this ground alone, it should be dismissed.

The CEC Act removes the Chief Justice of India from a high-level panel to select members of the Election Commission; under this law the three-member committee now includes the Prime Minister, a member of the union cabinet, and the Leader of the Opposition. The removal of the Chief Justice – seen as an impartial vote – has given rise to concerns the government can force-pick its nominees.

However, the government today argued independence of the ECI – tasked with organising polls- does not follow because a member of the judiciary is on the panel that selects the commissioners.

Individuals holding such high office are “presumed to act fairly”, the government said.

The Supreme Court is hearing yet another petition challenging exclusion of the Chief Justice from the panel that appoints election commissioners. Last month it refused, for a second time, to ban the law.

All of this comes with the Lok Sabha election now less than a month away.

The CEC Act came into sharp focus after two new Election Commissioners were appointed this month, days before the ECI announced dates for the Lok Sabha and four Assembly polls.

Arun Goel stepped down from the panel earlier this month and Anup Chandra Pandey retired last month, leaving only Chief Election Commissioner Rajiv Kumar on the three-member panel.

The appointments of Gyanesh Kumar and Sukhbir Singh Sandhu were promptly challenged, but have not, so far, been struck down or stayed by the Supreme Court.

The most recent petition against the CEC Act has been filed by the Association for Democratic Reforms, or ADR, an apolitical and non-partisan non-profit organisation working electoral and political reforms.

Last year, a Constitution bench of the Supreme Court ruled top poll officials must be appointed on the recommendation of a committee comprising the Chief Justice, the PM and the Leader of the Opposition.

Months later, the government passed a legislation dropping the Chief Justice from the selection panel and replacing him/her with a Union Minister, effectively giving itself a 2:1 majority.

Thousands of Kuki-Zo community people of Manipur, who have taken shelter in Mizoram following the ethnic violence in their home state, may not be able to exercise their franchise in the Lok Sabha polls, an official said on Tuesday.

No voting arrangement has been made for these Internally Displaced People (IDPs) from Manipur till now, an Election Commission official said.

According to Mizoram Home Department’s data accessed by PTI, altogether 9,196 adults and children from neighbouring Manipur have taken shelter in different parts of the state.

“A discussion is on among officials of the Election Commission to enable the Manipuris, displaced in different parts of the country, to exercise their franchise in the upcoming polls. However, till now, there is no plan to make special arrangements for them,” the official told PTI on condition of anonymity.

The two Manipur Lok Sabha seats will go to polls on April 19.

Chief Election Commissioner Rajiv Kumar recently said that the EC has drawn up a scheme to allow displaced people in Manipur to cast their votes from the camps where they are staying.

Manipur’s Chief Electoral Officer (CEO) Pradeep Kumar Jha had told reporters that the scheme is limited to the state’s territorial jurisdiction.

According to a tribal organisation of Manipur’s Churachandpur district, the Kuki-Zo people are also staying in Delhi and other cities across the country, besides Mizoram.

In the past, the Election Commission had allowed the IDPs to exercise their franchise from the host states.

Mizoram’s Bru people who fled to Tripura due to ethnic tension in 1997 were allowed to vote through postal ballots in Tripura’s relief camps. In 2018, however, exclusive polling stations were set up at a village on the Mizoram-Tripura border following opposition by Mizoram civil society groups that the Bru people should not vote in the relief camps.

The Kashmiri IDPs living in Delhi have been allowed to vote from Delhi.

Of the 9,196 people of Manipur who are staying in Mizoram, 1,340 are in 26 relief camps, while 7,856 are outside relief camps, the data said.

Aizawl district hosts the highest number of displaced Manipuris at 4,446, followed by Kolasib district at 2,674 and Saitual district at 1,275, it said.

The Manipuris, who took shelter in Mizoram mostly belong to the minority Kuki-Zo community, who share ethnic ties with the Mizos.

They have taken shelter in the northeastern state since May last year due to the ongoing ethnic violence in the neighbouring state.

Disillusionment and anger are palpable on the freezing streets of Ladakh capital Leh, where climate activist Sonam Wangchuk has been sitting on fast for nearly two weeks. “People are asking whether declaring Ladakh a Union Territory was a ploy to sell of our mountains to industrial lobby and mining companies,” he told NDTV.

The BJP, Mr Wangchuk said, had promised — not once but twice — that their demands will be met. “It was one of their poll promises. They promised us that they would protect the identity of Ladakh under the sixth schedule. But sadly, promises have not been kept. Ladakh has no democratic representation,” he added.

Mr Wangchuk also claimed the morale of the soldiers was at its weakest. “The morale of Ladakhi soldiers is broken because Ladakh has neither democracy (Assembly) nor reservation (for locals),” he said.

Almost five years ago, when Ladakh was declared a separate Union Territory, the people had celebrated. But now, “People in Ladakh are disillusioned and feel they have been taken for a ride. I can only say that they (the BJP) only think about elections and how many seats they can get, but forget about people,” he added.

“We want reassurance from the Centre that even though they have failed to live upto their promise up till now, they will not do so again,” he said. The people, he added, now want a multi-party legally binding agreement.

“We want to educate people in other parts of the country about how false promises were made to us. But we are not just fighting for Ladakh. It is for our nation,” he added.

People from 20 cities spread across India — including Mumbai, Pune and Hyderabad — have come out in support of Ladakh. Huge protests have been planned on March 20 and again on March 24. “We are also asking international communities to come out and support our cause,” he added.
