The CCTV footage of the May 13 incident, in which AAP MP Swati Maliwal was allegedly assaulted at Delhi Chief Minister Arvind Kejriwal’s residence, may have been tampered by main accused Bibhav Kumar to destroy evidence, Delhi Police have said.

In its remand note, police have said a portion of the footage from CCTV cameras at the Chief Minister’s residence is showing blank.

Ms Maliwal took to social media to stress this point. Referring to the 2012 Delhi gangrape-murder, she tweeted, “There was a time when he hit the streets to get justice for Nirbhaya. Twelve years later, they are hitting the streets to save an accused who deleted CCTV footage and formatted the phone. I wish they had tried so hard for Manish Sisodia. If he was here, maybe something so bad would not have happened to me,” she said. Mr Sisodia, Delhi’s former Deputy Chief Minister, is in jail for over a year now in the Delhi liquor policy case.

Police have said they have not received the Digital Video Recorder so that they can scan the May 13 footage as part of their probe. The CCTV cameras at the Chief Minister’s residence come under the purview of the Public Works Department (PWD). A junior engineer from the department has given police one video in a pen drive that was found blank, the remand note says. The investigation revealed that the junior engineer does not have access to the DVR, it adds.

Bibhav Kumar, Chief Minister Kejriwal’s close aide, has been arrested and remanded in police custody for five days.

Delhi Police have said the accused is not cooperating in the probe. They have said he worked in the influential position of the Chief Minister’s personal secretary for nine years and can tamper evidence and influence witnesses. The remand note also says Bibhav Kumar was appointed as the Chief Minister’s personal secretary in February 2015 and removed in April this year over a 2007 case of obstructing a public servant from working. Police are now probing why he was still working at the Chief Minister’s residence.

The remand note says assault on an MP is a very serious matter and the attack could have turned fatal. When Bibhav Kumar was questioned about the incident, he was evasive, it adds. The statement of Ms Maliwal is consistent with her medical report, it says.

The accused’s iPhone 15 has been formatted and needs to be examined by a data expert, police have said.

Bibhav Kumar’s counsel Rajiv Mohan has said Ms Maliwal visited the Chief Minister’s residence without an appointment and that Delhi Police was distorting facts. He also said she filed the police complaint on May 16 — three days after the incident.

He said neither did Ms Maliwal seek any medical aid after calling the emergency helpline, nor did the station house officer prepare any medical sheet after meeting her.

The lawyer alleged that Ms Maliwal was politicising the issue of having suffered injuries and giving statements to the media.

In its rebuttal, the Delhi Police counsel said that according to the FIR, Ms Maliwal was “in shock” after the assault and filed a police complaint after recovering.

A Rajya Sabha member and former chief of the Delhi Commission for Women, Ms Maliwal has alleged that Bibhav Kumar had slapped her multiple times and kicked her during the May 13 incident. AAP MP Sanjay Singh had earlier said the Chief Minister’s aide had misbehaved with her and that Mr Kejriwal will take strict action. The AAP has now said the BJP has made Ms Maliwal part of a conspiracy.

“Anti-Corruption Bureau of the BJP has filed a case against Swati Maliwal regarding the illegal recruitment of contractual employees in DCW. A charge sheet has been filed and the time of conviction is coming, we believe that Swati Maliwal is being included in the conspiracy by using this case.” AAP leader and Delhi Minister Atisi told the media yesterday.

Mumbai billboard case: Bhavesh Bhinde managed to evade police for 3 days but was arrested from Udaipur.

At the heart of the tragic billboard collapse in Mumbai, which claimed 16 lives, was an advertising agency, Ego Media Pvt Ltd, that had installed the fateful structure. The owner of the company, Bhavesh Bhinde, managed to evade police for 3 days, but was finally arrested from Udaipur.

He was arrested after an extensive manhunt spanning three states.

The collapse of the 120 feet by 120 feet billboard claimed the lives of 16 and left 75 others injured. The catastrophic incident, which occurred amidst strong winds and unseasonal rains, prompted swift action from law enforcement agencies.

Following his realization that the police were closing in on him, Bhavesh Bhinde fled, setting off a pursuit that led through various cities. To evade capture, he kept changing his location and assumed a false identity.

His flight led authorities to Lonavala, Thane, and Ahmedabad before finally ending in Udaipur, where he was found hiding in a hotel under an assumed name. He would be in a new city every time the cops closed in on him, and Mumbai Police had to deploy eight teams, which worked round the clock, to track Bhinde.

The team revealed that Bhavesh Bhinde, upon learning of the impending police action, initially fled to Lonavala before returning to Mumbai the next day. Subsequently, he traveled to Thane, but continued his elusive journey to Ahmedabad, ultimately seeking refuge in a hotel in Udaipur, where he was finally nabbed by the Crime Branch.

He was finally caught after the investigation team utilised a combination of technical expertise and human intelligence.

The Udaipur operation was so discreet that even the local police were not informed that a team was in town to catch Bhinde.

“The operation was a top secret, and even the Udaipur police did not know about it,” said an official on the investigating team.

The hoarding collapsed onto a nearby petrol pump in the Chhedanagar area in Ghatkopar during gusty winds and heavy unseasonal rains, killing 16 people and injuring 75 others.

Delhi Chief Minister Arvind Kejriwal’s release on interim bail was “not an exception” the Supreme Court said today after the government complained that its decision has been criticised by many. “We have not made any exception for anybody. We said in our order what we felt was justified,” said a bench of Justices Sanjiv Khanna and Dipankar Datta, who had given the order over the weekend, providing a boost to the Aam Aadmi Party during elections.

In an unexpected step, court, which was hearing the Chief Minister’s challenge to his arrest last week, also said it would hear his appeal for bail.

While granting interim bail in the same hearing, the judges had made their reasoning clear: That elections are “vis viva” (life force) of a democracy and Mr Kejriwal heads a national party, that he is not convicted and is not a threat to society.

The top court’s move also follows its frequent argument for bail being the rule and jail an exception.

The bench also steered clear of political leaders’ comment on the matter.

Earlier this week, Union Home Minister Amit Shah said he does not see the Supreme Court’s decision as a routine judgment and stressed that many in the country believe that “special treatment” was given.

When senior advocate Abhishek Singhvi, who was representing Mr Kejriwal, referred to the matter without naming the minister, the court said it would not go into that.

The judges also put aside the Enforcement Directorate’s argument – that Mr Kejriwal’s comment that if the INDIA bloc wins, he would “not have to go back to jail” — is a contempt of the court.

Calling it an “assumption” of the Chief Minister, the judges said, “Our order is very clear about when he has to surrender. It is the order of the Supreme Court. The rule of law shall be governed by this order”.

A year on, Manipur is yet to see normalcy after the Meitei-Kuki ethnic violence

India’s top anti-terror body NIA has said insurgents from Manipur hiding in Myanmar infiltrated the state amid the ethnic violence last year, and trained “impressionable youths” to participate in gunfights.

The National Investigation Agency (NIA) in a chargesheet given to a court in Assam’s Guwahati on March 27 said the China-Myanmar module of the insurgent group NSCN(IM) gave logistics and other support to the proscribed terrorist organisations KYKL, and the PLA.

NDTV has seen a copy of the chargesheet.

The banned Kanglei Yaol Kanba Lup (KYKL) and the People’s Liberation Army (PLA) are Meitei insurgent groups. The National Socialist Council of Nagalim (Isak-Muivah), or NSCN(IM), is a Naga insurgent group that signed a framework agreement with the government which Prime Minister Narendra Modi had described as a “historic” step to bring peace.

The NIA, giving a background of the case, in the chargesheet said the Centre had received intelligence about a transnational conspiracy hatched by the Myanmar-based leadership of the “terror outfits” to destabilise the security situation in Manipur, and “wage a war against the government of India”.

The KYKL and PLA leadership in Myanmar decided to infiltrate their insurgents into Indian territory to carry out terror attacks, the NIA said. To this end, the NSCN(IM) leadership promised safe passage, arms, ammunition, explosives, and other terrorist hardware to them, the NIA said in the background note which is a part of the chargesheet.

The ethnic violence that began in May 2023 between the valley-dominant Meitei community and the Kuki-Zo tribes, who are dominant in the hill districts of southern Manipur and a few other hill areas, presented a “fertile ground” for the Myanmar-based leaders of these terror outfits to exploit, the NIA said in the chargesheet.

Manipur Police commandos during routine checking in the state capital Imphal had arrested five armed men in military camouflage from an SUV in September 2023. All the five later got bail following protests by locals; however, the NIA immediately arrested one of them, Moirangthem Anand Singh, who turned out to be a highly trained member of the PLA, according to the chargesheet.

The NIA in the chargesheet said Anand mobilised local youths for arms training to escalate the ethnic strife in Manipur. In July 2023, he participated in a weapons-training camp in Manipur organised by two more PLA insurgents, who taught 80-90 youths to handle firearms, the NIA said.

“The investigation… shows the accused criminally conspired with intent to carry out violent terror attacks targeting the rival Kuki-Zo community with prohibited arms and ammunition which were looted from various government sources,” the NIA said in the ‘analysis of evidence’ part of the chargesheet.

“The accused persons were thus part of the larger transnational conspiracy hatched by Myanmar-based leadership of terror outfits operationally active in the northeastern Indian states to exploit the ongoing ethnic unrest in Manipur, and execute terror attacks to aggravate the worsening security situation in Manipur,” the NIA said.

The NIA had also arrested Seiminlun Gangte as one of the key accused in an SUV blast in Bishnupur, 45 km from Imphal, in June last year.

“Not Only Misleading, But Cruel,” Says NSCN(IM)

The NSCN(IM) in a statement shared with the media alleged the Centre – despite having signed a ceasefire and engaging in talks for 27 years – has been supporting a proxy war against it by using the Myanmar-based Kuki National Army (B), or KNA(B), and the People’s Defence Force (PDF).

The allegations are “not only misleading but cruel and vicious as it is too far from the point of accuracy and morally not ethical at all,” the NSCN(IM) said.

The Kuki tribes had fought with the Nagas in the 90s after the Nagas accused them of encroaching on their land. Many from both tribes were killed in that conflict.

“The security forces… use the Kukis as frontal forces to engage in bloody discord against the Nagas giving all logistics support to the Kuki militant groups,” the NSCN(IM) alleged in the statement.

In May 2023, the month Meitei-Kuki ethnic violence began, the NSCN(IM) had asked the two communities to ensure the hostilities between them do not affect the Nagas living in the violence-hit state. The NSCN(IM) had alleged some “Kuki militants” attacked a village where members of the Kom community – a Naga minor tribe – live in Manipur’s Kangathei.

The Manipur assembly on February 29 unanimously passed a resolution asking the Centre to scrap the controversial suspension of operations (SoO) agreement with some 25 Kuki-Zo insurgent groups. The deadline for extension of the SoO agreement ended that day. The Kuki-Zo insurgent groups signed the tripartite SoO agreement with the Centre and the Manipur government in 2008.

The over two dozen Kuki-Zo insurgent groups come under two umbrella groups – the Kuki National Organisation (KNO), and the United People’s Front (UPF). These two representing the others have signed the SoO agreement. They have been demanding a separate land for the Kukis.

The ethnic violence killed over 220 and internally displaced nearly 50,000. A year on, thousands are still living in relief camps in both the Meitei-dominated valley and Kuki-dominated hill areas.
