Court Rejects Shooter Vartika Singh's Defamation Case Against Smriti Irani


The court said that Smriti Irani had no intention of defaming the petitioner.

The Allahabad High Court has dismissed international shooter Vartika Singh’s plea challenging an MP/MLA court order rejecting her defamation complaint against Union minister Smriti Irani.

The Lucknow bench of the high court said that while replying to journalists’ questions, if the petitioner was said to be associated with the Congress party or the “Gandhi family”, it was not her defamation.

The bench of Faiz Alam Khan passed the verdict on March 5 which was uploaded on Monday.

Vartika Singh had filed a case in the Sultanpur MP/MLA court, accusing Ms Irani of defamation. The case was dismissed by the special court on October 21, 2022.

The petitioner had challenged the MP/MLA court’s order in the high court.

Ms Singh’s allegation was that when journalists asked Irani about the allegations made by the petitioner against her personal secretary, Ms Irani described the petitioner as a “pawn” of the Congress and said she was having direct links with the Gandhi family.

Quoting Irani’s entire conversation with journalists, the high court said that before giving the statement in question, Ms Irani talked about other matters and during this time she did not even take the name of the petitioner.

The court said that when asked about the petitioner, Ms Irani had said the petitioner had links with the Congress and also had a criminal history. The court found that criminal cases were registered against the petitioner.

The bench said that if the court looks at Ms Irani’s statements, she was criticising a political party and she had no intention of defaming the petitioner.

The Supreme Court on Monday refused to stay the “hard-earned” acquittal of ex-Delhi University professor GN Saibaba and five others, all of whom had been accused of Maoist links and charged under stringent anti-terror law UAPA. The court also rejected an oral request by the Maharashtra government for an early listing of its plea against the verdict of the Bombay High Court’s Nagpur bench.

“There cannot be urgency in order of reversal of conviction. Had it been the other way around, we would have considered,” a bench of Justice BR Gavai and Justice Sandeep Mehta said, adding also that prima facie they found the Nagpur bench’s judgement to be “very well-reasoned”. 

The Supreme Court further pointed out that all six had been acquitted twice – by two different benches.

In 2022 the High Court had ruled that valid sanction had not been obtained to prosecute Prof Saibaba under anti-terror law UAPA. And last week the Nagpur bench found no evidence to link the professor, or the others, to any terrorist act, and also cast doubts over “seizures” claimed by the state police.

“Prosecution has failed to prove, beyond reasonable doubt, the case against the accused persons,” a division bench of Justices Vinay Joshi and Valmiki SA Menezes had said last week.

The court, further, held as “null and void” the sanction procured by the prosecution to charge the accused under UAPA, or the Unlawful Activities (Prevention) Act, and said, “Prosecution has failed to establish legal seizure or incriminating material against the accused.”

Referring to these, the Supreme Court set aside Prof Saibaba’s sentence; this comes nearly 10 years after he was arrested and lodged in Nagpur Central Jail in 2014.

Justice Mehta called the professor’s acquittal “hard-earned”.

The professor had been convicted of alleged Maoist links, and indulging in activities amounting to waging war against the country, by a sessions court in Gadchiroli district.

Speaking after his release, he said he wanted to be reinstated and compensated for lost years of service; he had been fired Delhi’s Ram Lal Anand College in 2021.

“I am still not able to register that I am free. I feel I am still lodged in the notorious jail cell. It was like an ‘agni pariksha’ for me. I had to go through a test by fire twice,” he said.

A professor and his daughter were found dead inside his office at a university campus in Haryana this evening, hours after he told his wife they were going on a short scooter ride. He slit the throat of his eight-year-old daughter with a surgical blade before dying by suicide. He used the same blade to cut his throat.

The bodies of Sandeep Goyal and his daughter were found by his wife inside the office at Lala Lajpat Rai University of Veterinary and Animal Sciences (LUVAS) in Hisar.

His colleagues hinted that he was in depression, police said. “We will speak to the concerned doctor to find out about his exact health condition”, said Hisar assistant superintendent of police Rajesh Mohan. A forensics team is also at the scene, he said.

Goyal, 35, left home with his daughter around 4 pm under the pretext of taking her for a ride on his scooter. When they didn’t return for hours, his wife went to the university to look for them. She spotted his scooter parked outside the Department of Veterinary Surgery and Radiology but found the gate locked from inside. She alerted security personnel immediately. To her horror, as the gate opened, she found her husband and daughter in a pool of blood.

Sandeep Goyal was working as an assistant professor at the LUVAS university since 2016.

Her post, which attracted widespread attention and engagement, delved into the story of a candidate whose initial interview performance belied the potential Mrs Hyacinth sensed within.

In her LinkedIn post, the CEO and founder of Leadership EQ recounted the pivotal decision she made in hiring a candidate who “struggled” to communicate during the interview process. Despite the visible nervousness and the challenges the candidate faced in effectively conveying their thoughts, Mrs Hyacinth found herself relying on a hunch-an intuition that told her this individual was the right fit for the job.

“Disaster! So, I interviewed a highly recommended candidate. The interview was a nightmare. She was so nervous she could barely communicate. A deer in the headlights. She bombed miserably. Still, I couldn’t get past my gut feeling that she was the best candidate for the job. Is it possible to overlook a poor interview performance?” Hyacinth posted on LinkedIn.

The post detailed the challenging interview, highlighting the candidate’s difficulties in communication. Mrs Hyacinth, however, couldn’t dismiss her gut feeling that this struggling interviewee possessed untapped potential. This internal conflict led her to question the conventional wisdom surrounding job interviews: Can a lackluster interview truly reflect a candidate’s capabilities?

Choosing to trust her instincts, Mrs Hyacinth decided to take a chance on the nervous interviewee. To her surprise, within six months, the once-struggling candidate transformed into one of her top performers. This success story became a testament to the limitations of interviews in providing a comprehensive assessment of an individual’s abilities.

“I gambled and decided to give her a try, and within six months, she was one of my top performers. Sometimes, it’s hard to know a candidate’s full capabilities in a job interview. We shouldn’t be too quick to cross someone off who doesn’t interview well. The truth is interviews can be nerve-wracking. There is so much more to a person than just passing/failing an interview,” she added.

The LinkedIn post struck a chord with the professional community, amassing over 95,000 likes and sparking a discussion in the comments section.

LinkedIn users resonated with the shared sentiment, expressing empathy for the nervousness experienced during interviews and advocating for a shift towards evaluating actions over words in the hiring process. One user underscored the disconnection between interview performance and on-the-job success, emphasising the complexity of assessing individuals solely through interviews.

“And then there are candidates who are excellent at interviews, that gets them the job, and they go on to become really miserable performers (talkers, rather than doers kind). Like your gut instinct told you that that candidate, even though she interviewed ‘miserably’, is now one of your top performers; that gut instinct to be able to identify talent and give them a chance by taking that risk is also an intrinsic marker of ‘leadership’. Unfortunately, there are not many leaders out there, and hence we see what we see, in terms of acquiring and retaining talent,” an individual said.

Notably, a user proposed a practical solution to ease candidate nervousness-sending interview questions in advance to gauge preparedness and alleviate stress.

“During my next round of interviews, when I send an appointment for the interview, I plan on sending them the questions I want to ask to give them more time to prepare. They may be less nervous, and it will let me see if this is someone who took the time to read the questions I ask”.

Mrs Hyacinth’s anecdote had ignited a conversation on the nuances of interviewing and the multifaceted nature of assessing a candidate’s potential.

Congress Lok Sabha Election First Candidates List: 16 candidates have been announced for Kerala.

Less than a week after the BJP announced its first list of 195 candidates, the Congress has come up with its answer in the form of 39 names, including those of Rahul Gandhi, Shashi Tharoor and Bhupesh Baghel.

Rahul Gandhi will contest from Wayanad in Kerala but it is not clear whether he will also be fielded from Amethi, like in 2019. Shashi Tharoor will fight from Thiruvananthapuram, a seat he has held for three terms, while Mr Baghel will contest from Rajnandgaon in Chhattisgarh.

Some of the other big names on the list are Congress General Secretary KC Venugopal, who will contest from Alapuzzha in Kerala – a seat he had won in 2009 – and DK Suresh, brother of Karnataka Deputy Chief Minister DK Shivakumar, who has been fielded from Bengaluru Rural. 

The names have been announced primarily for some southern and northeastern states and the only outliers are Chhattisgarh and the Union Territory of Lakshadweep. At 16, the bulk of the candidates have been announced from Kerala, where the Congress is expected to leave the remaining four seats for its allies. 

Seven names have been announced from Karnataka, six from Chhattisgarh and four from Telangana. The remaining are from Meghalaya, Nagaland, Sikkim, Tripura and Lakshadweep.

The focus on the south is deliberate because not only does the Congress have its governments in the states of Karnataka and Telangana, but it is also the only region in the country where the BJP is relatively weak. 

Focus On Communities

While announcing the names on Friday, Mr Venugopal said the candidates had been picked by the Congress Central Election Committee. He emphasised that 24 of the 39 candidates are from the OBC, SC, ST and minority communities. 

Sources said this list is a start and more names can be expected as the INDIA alliance finalises seat-sharing in some of the remaining states, including Maharashtra. Deciding on pacts for the state, which sends the second-highest number of MPs to the Lok Sabha, has proved to be troublesome for both the NDA and the INDIA alliances. 

Another reason behind the delay could also be the fact that Rahul Gandhi is busy with the Bharat Jodo Nyay Yatra, which is in Gujarat and will end in Mumbai on March 17. Mr Venugopal said there will be a massive rally in the city on that day and the leaders of all INDIA party leaders are being invited for it.
