Article 370 Gone For Good – Supreme Court Backs Scrapping Of J&K Autonomy



Supreme Court upheld the constitutional validity of move to scrap J&K special status

New Delhi:

The Supreme Court today backed the Centre’s move to scrap special status to Jammu and Kashmir under Article 370 of the Constitution and ordered elections next year.

Article 370 was a temporary provision to ease Jammu and Kashmir’s merger with India, said Chief Justice of India DY Chandrachud, reading out a majority Supreme Court judgment.

The Supreme Court said Jammu and Kashmir should be put on par with other states “at the earliest and as soon as possible”, and called for state elections by September 30, 2024.

Jammu and Kashmir did not retain sovereignty when it joined India and its constituent assembly ceased to exist the moment it merged with India, the Supreme Court said, explaining the decision.

“The J&K constituent assembly was not intended to be a permanent body. It was formed only to frame the Constitution. The recommendation of the Constituent Assembly was not binding on the President,” said Chief Justice Chandrachud.

The Supreme Court, however, explained why the state continued to enjoy special status even after its merger with India, despite the state not having “internal sovereignty”.

“When the constituent assembly ceased to exist, the special condition for which Article 370 was introduced also ceased to exist. But the situation in the state remained, and thus the Article continued,” the Supreme Court said.

“All states in the country have legislative and executive power, albeit to differing degrees. Article 371A to 371J are examples of special arrangements for different states. This is an example of asymmetric federalism… Jammu and Kashmir does not have internal sovereignty different from other states,” the Supreme Court said.

The bench gave three separate judgments – one authored by Chief Justice Chandrachud on behalf of himself, Justice BR Gavai and Justice Surya Kant; another concurring judgment by Justice Sanjay Kishan Kaul, and a third judgment concurring with the other two by Justice Sanjiv Khanna.

Article 370 gave Jammu and Kashmir its own Constitution and decision-making rights for all matters barring defence, communications and foreign affairs. Its removal ended special status to the state.

Contained within Article 370 was Article 35A, which allowed the erstwhile state to define who it acknowledged as permanent residents and gave special rights, such as government jobs and owning property.

The Supreme Court said it did not find it necessary to see whether the reorganisation of Jammu and Kashmir into a Union Territory was valid since it was a temporary arrangement until the election and restoration of statehood.

Sitapur:

Aggrieved over his mother for not transferring a land parcel to his name, a man allegedly decapitated her in a village on Saturday, police said.

The incident took place in Mejapur village under the Taalgaon police station area, they added.

Dinesh Pasi (35) allegedly killed his mother Kamla Devi (65) by chopping her head off with a farming blade, Sitapur SP Chakresh Mishra said.

The headless body which was recovered from outside their home has been sent for post-mortem, he said, adding that the accused is missing.

Dinesh Pasi, who is an alcoholic, allegedly murdered his mother as she refused to transfer a land parcel to his name, Mr Mishra said. Efforts are underway to nab the accused, the SP added.

Telangana BJP legislator T Raja Singh has refused to be administered his oath by AIMIM’s Akbaruddin Owaisi, who was appointed by the protem speaker of the state assembly. Mr Singh, who won from Goshamahal in last month’s assembly elections, said none of the BJP lawmakers would take oath.

In a video message, he said he would never take oath “as long as he is alive” in front of AIMIM. He said he would take oath only after a full term speaker is appointed.

“Can I take oath in front of a person (Akbaruddin Owaisi) who made anti-Hindu comments in the past,” he asked.

Mr Singh had refused to be administered oath in 2018 too since the Protem Speaker appointed then was also from the AIMIM.

Mr Owaisi was expected to take oath as the Protem Speaker on Saturday and then administer the oath to the elected MLAs on the same today.

Mr Singh alleged that Congress’s Revanth Reddy, the new Chief Minister of Telangana, is scared of the AIMIM like his predecessor K Chandrashekar Rao, and thus allowed Mr Owaisi to be the Protem Speaker.

The seniormost MLA in the assembly is made the Protem Speaker, as per the protocol. Mr Owaisi was elected to the assembly (including the united Andhra assembly) from Chandrayangutta constituency for the sixth time.

However, Mr Singh claimed there are many senior MLAs who could have been made the Protem Speaker, but the new Chief Minister was trying to appease the minorities and AIMIM leaders.

Aligarh:

She was visiting the police station for her passport verification. And was awaiting her turn. Just then, a cop, cocking a gun, misfired. The bullet hit the woman, sending her crashing to the floor, showed the disturbing video from Uttar Pradesh’s Aligarh.  

The woman, Ishrat, has been rushed to a hospital, where her condition is said to be critical.

The accident took place around 2:50 pm. The accused policeman is missing.

The family has alleged that the woman was being harassed for money by the officer in charge of her passport verification. An argument followed and the officer shot her, claimed the family.

“She had visited the police station for passport inquiry. She was getting calls for money. Don’t know who shot her. Don’t know about the money demanded. There was an argument between them,” said Jeeshan, a relative of the 55-year-old injured woman.

The video shows the woman standing with a man awaiting her turn when the cop comes in and is handed a gun by his colleague. The cop is seen testing the gun when the shot is fired and the woman collapses to the ground.

“Due to negligence, Inspector Manoj Sharma has been suspended with immediate effect and a criminal case has been registered against him. The injured woman is being treated by the doctor’s team, the footage of the incident is being investigated by the field unit,” said Kalanidhi Naithani, SSP, Aligarh.

The woman was hit in the back of the head, the officer said, adding that teams have been formed and strict action will be taken against the accused policeman.

The woman was planning to visit Saudi Arabia for Umrah, a mini pilgrimage.

Four Union Ministers have been given additional portfolios

New Delhi:

President Droupadi Murmu has accepted the resignations of Narendra Singh Tomar, Prahlad Singh Patel and Renuka Singh Saruta from the Union Council of Ministers. They had resigned following their victory in the recent assembly elections.

Union Minister Arjun Munda has been assigned Agriculture and Farmers Welfare Ministry, in addition to his existing portfolio.

Minister of State Shobha Karandlaje has been given charge of Minister of State in Food Processing Industries, in addition to her existing portfolio.

Union Rajeev Chandrasekhar will work as Minister of State in Jal Shakti, in addition to his other portfolios.

Union Minister Bharti Pravin Pawar has been given additional charge of Minister of State in Tribal Affairs.

Union Ministers Tomar, Patel and Saruta resigned as the BJP had decided that all of its 12 MPs recently elected to state assemblies will quit parliament, amid strong indications that they may join the new governments in Madhya Pradesh, Chhattisgarh and Rajasthan.

Saruta, a Lok Sabha MP from Chhattisgarh, had recently contested state assembly elections and won the Bharatpur-Sonhat seat.

Other MPs who quit are Rakesh Singh, Udya Pratap Singh and Riti Pathak from Madhya Pradesh; Kirodi Lal Meena, Diya Kumari and Rajyavardhan Singh Rathore from Rajasthan and Gomati Sai and Arun Sao from Chhattisgarh.

All except Meena are Lok Sabha members. Meena is a Rajya Sabha member.
