5 Big Changes As US Releases Proposed Tweaks To H-1B Process

The H-1B visa program has long been a pivotal aspect of immigration in the United States, particularly for skilled professionals and international students.

The Biden administration recently unveiled a set of changes to the H-1B program, aimed at improving its integrity and flexibility while addressing the evolving needs of the American workforce. US-based author Soundarya Balasubramani decodes the proposed changes in the H-1B visa process.

No More Multiple Entries
One of the most significant changes involves the elimination of multiple entries by employers on behalf of the same employee. In 2023, over half of the approximately 800,000 H-1B registrations were multiple entries, artificially inflating the chances of some applicants. To combat this, an employee can only be registered once, and employers will now be required to submit passport information for each employee. This allows the United States Citizenship and Immigration Services (USCIS) to ensure a fair and equitable selection process. Attempts to bypass this rule will lead to denials or revocations.

No Need For “Employer-Employee” Relationship
The previous requirement for an “employer-employee” relationship, imposed in 2010, has been a significant hurdle for founders looking to secure H-1B visas through their own companies. The new rule eliminates this requirement, making it easier for entrepreneurs to utilize the H-1B program to build and grow their businesses, even if they own more than 50% of the company.

Job Offer Can Be Remote
In a nod to the post-pandemic world, the Department of Homeland Security (DHS) acknowledges that a bona fide job offer can now include telework, remote work, or other off-site work within the United States. This change aligns with the widespread adoption of remote work arrangements.

Automatic “Cap-Gap” Extension
A substantial victory for international students is the extension of the “cap-gap” provision. Under the previous system, F-1 Optional Practical Training (OPT) could only be extended until October 1st. However, with the proposed rule, students can extend it until April 1st of the following year or until they receive their H-1B visa, whichever comes first.

Increased Site Visits
To combat fraud, particularly in the IT consulting sector, USCIS will conduct more and stricter site visits. Inspectors may visit unannounced, interview officials, review records, and speak with employees. These measures aim to ensure that employers comply with the H-1B program requirements.

Stricter Definition Of “Specialty Occupation”
Another notable change is the stricter definition of a “specialty occupation.” Under the new rule, there must be a direct relationship between the required degree field and the position’s duties. This change could potentially lead to more Requests for Evidence (RFEs) and denials for deserving candidates.

Public Comment Period
The proposed changes to the H-1B program have not been set in stone. The Department of Homeland Security has initiated a “public comment period” that runs until December 22nd, 2023, allowing individuals to provide feedback and input. This presents an opportunity for immigrants, employers, and other stakeholders to shape the final regulations.

The move represents a significant step in modernizing and adapting the system to the needs of today’s workforce. While some changes may face criticism, they also address long-standing issues and provide opportunities for entrepreneurs, students, and skilled professionals. It’s important to note that these proposed changes are not final.

The rule is currently open for public comment until December 22, 2023. After this period, the Department of Homeland Security will review the feedback and aim to publish a final rule, expected in 2024. In powerful remarks on the ongoing war in Gaza, a Saudi Arabia prince, who was the country’s former intelligence chief, has slammed both Hamas and Israel and said there are “no heroes in this conflict, only victims”. Turki Al Faisal’s speech at a US university also mentions India when he cites the example of the Independence movement as an example of resisting occupation through civil disobedience.

A viral video of the address starts with the 78-year-old saying that all occupied people have a right to resist their occupation, even militarily.

“I do not support the military option in Palestine. I prefer the other option: civil insurrection and disobedience. It brought down the British empire in India and the Soviet empire in eastern Europe,” he said.

Israel, he said, has overwhelming military superiority and the world can see the devastation it is causing in Gaza.

Hitting out at Hamas for the October 7 attacks that sparked the war, Faisal said, “I categorically condemn Hamas’ targeting of civilian targets of any age or gender as it is accused of. Such targeting belies Hamas’ claims to an Islamic identity,” he said.

There are Islamic injunctions, he said, against the killing of innocent children and women and the elderly, and against desecration of places of worship.

Hamas’ surprise attacks on Israel cities and the brutal retaliation have claimed over 5,800 lives so far, according to UN estimates.

The Saudi prince slammed Hamas for “gifting the high moral ground to an Israeli government that is universally shunned”. “I condemn Hamas for giving this awful government the excuse to ethnically cleanse Gaza of its citizens and bombing them to oblivion,” he said.

The Saudi prince also slammed Hamas for sabotaging Saudi Arabia’s attempt to reach a peaceful resolution to the Palestine issue. Multiple experts have said the normalisation of Israel-Saudi Arabia relations, which was paused due to the war in Gaza, was a crucial backdrop against which Hamas planned its unprecedented attack.

The Saudi prince minced no words in his criticism of Israel for its counterstrike that targeted innocent civilians in Gaza and West Bank. “Two wrongs don’t make a right,” he said.

Countering the US media’s use of “unprovoked attack” to describe Hamas’ offensive in Israel, Faisal said, “What more provocation is required to make it provoked than what Israel has done to the Palestinian people for three-quarters of a century?”

Flagging Israel’s alleged excesses in Palestine and the killing of civilians, he said, “This bloodletting must stop.”

“I condemn Israel’s stealing of Palestinian lands,” he said, further accusing Tel Aviv of targeted killings of Palestinians and jailing civilians.

The Saudi prince also hit out at Western politicians for “shedding tears” when Israelis are killed by Palestinians but “refusing to even express sorrow” when it’s the other way around. “There are no heroes in this conflict, only victims,” he said.

Faisal led the Saudi intelligence agency Al Mukhabarat Al ‘Ammah for 24 years and also served as the country’s ambassador to London and the US. While he does not hold any public office at this point, it is unlikely that his remarks do not have the backing of Saudi leadership. Against this backdrop, the comments are being seen as an articulation of Riyadh’s position on the ongoing war.

Around the festive months of October and November, a lot of brands release advertisements based on the theme of happiness, celebrations with family, and traditions. Similarly, a prominent brand, Nalli Silks, recently released an advertisement to promote their new designs. However, it was met with a lot of backlash as the model, who was wearing a beautiful saree, was spotted without a bindi. According to beliefs, any ethnic attire, especially during festivities is seen incomplete without proper jewellery and bindi. The bindi is also considered a symbol of good luck. Several users on the internet were disappointed with the same and #NoBindiNoBusiness started trending on social media. A section of people were also outraged because the advertisement also came at the auspicious time of Navratri.

Social Media Reactions

The missing bindi drew ridicule for the brand. Many dissatisfied users vented their frustrations online, with the hashtag “No Bindi No Business” trending on microblogging platform X, formerly Twitter. “Look at this advertisement. Even a traditional firm like Nalli is using a model who is not wearing a bindi and looking morose. Doesn’t look like a celebration,” said a user.

“First of all wear a Bindi. Nalli! You get most of your business from Hindus, who purchase silk sarees for Wedding, deepavali Pongal etc and still you try to play this ugly trick. Shameful!” remarked another person.

A third user said, “Sad to see even a brand like @NalliSilk falling for the grumpy, no-bindi, mourning look! #NoBindiNoBusiness.”

“People visit Nalli for festive shopping. This hardly seems festive,” added a user. “What’s this Dull, deadpan look without Bindi ? This is festival time, is she going to a funeral?” added another user.

“Never again buying from @NalliSilk , this is not a mistake this is on purpose,” commented a person. 

Some also added that they would “boycott” the brand completely. 

However, some people came in support of the brand. “Wat d F’s wrong wid ppl these days? Who r these custodians of culture who r slamming d Ad put out by Nalli Silks? We wear a bindi wen we feel lyk. Whether one’s spouse is dead or alive, doesn’t matter! It hs no bearing on wat we choose 2 wear or nt wear!” remarked a person.

New Advertisement

After a lot of criticism, Nalli Silks launched another advertisement which was shared by actor Soni Srivastava. In the clip, several models are seen dressed in Nalli Silk Sarees and are flaunting their jewellery and bindis.

The reel began with a woman wearing a bindi on her empty forehead, followed by others applying kajal, wearing nose rings and earrings and adding fragrant flowers to their one’s hair along with bangles and necklaces to give a festive vibe.

Similar Cases

Recently, HDFC Bank faced criticism for its new “Vigil Aunty” ad. In the advertisement, a character named “Vigil Aunty” was seen wearing a bindi resembling a stop sign. The advertisement was part of the 2022 HDFC campaign, which aimed to promote secure banking practices nationwide. HDFC Bank collaborated with actress Anuradha Menon to play “Vigil Aunty” for this cyber fraud awareness initiative.

However, the ad faced criticism online, with some people labelling it as anti-Hindu. An upset user wrote on X, “HDFC Bank What is this? How can you mock Hindu women like this? Do Hindu women wear bindi like this? What the need of a women in vigil army.” 

Another agreed, saying, “@HDFC_Bank @HDFCBank_Cares Whoever is your creative head, he/she lacks basic manners of respecting cultural sensitivities of a majority of your customers. $tupidity at it’s best.”

Prime Minister Narendra Modi on Saturday attended the 125th Founders’ Day celebrations at The Scindia School in Madhya Pradesh’s Gwalior. During the event, as a special gesture, the musical duo Meet Bros presented a special song for the Prime Minister. The Indian musical, comprising of brothers Manmeet Singh and Harmeet Singh – who also happened to be Scindia School alumnus, sang the recently released Garba song penned by PM Modi himself. The song is titled ‘Maadi’. 

Taking to X (formerly Twitter), the Prime Minister shared the video of their performance. In the clip, he is seen smiling and enjoying the song while tapping his hand on his knee. “At @ScindiaSchool, @Meetbros sung the Garba penned by me. Incidentally, they are proud alumnus of Scindia School,” he wrote in the caption the post.

The video quickly garnered the attention of several users. In just a few hours, it accumulated over 145,000 views. In the comment section, while some praised Meet Bros for their performance, others lauded PM Modi for the lyrics of the song. 

“Meet Bros are fantastic duo. Mesmerized to hear their live performance,” wrote one user. “Fantastic to see @Meetbros showcasing their talents and celebrating their Scindia School connection through Garba,” said another. 

“This is heartwarming!” commented a third user. “Wow! Modi Ji, you are no less than a poet,” added another.

Notably, PM Modi shared the song – sung by Divya Kumar and composed by the Meet Bros – on YouTube and X earlier this month. The song is four minutes and 40 seconds long and is sung in Gujarati. “As the auspicious Navratri dawns upon us, I am delighted to share a Garba penned by me during the past week. Let the festive rhythms embrace everyone!” PM Modi wrote while releasing the video of the same. 

‘Maadi’ is the second song penned by PM Modi. Before this, the Prime Minister also shared another Garba song, which he authored several years ago. The song, titled ‘Garbo’, is sung by Dhvani Bhanushali and composed by Tanishk Bagchi. 

“Inspired by the poetic notes penned by none other than the one and only PM Narendra Modi. GARBO transports us to witness the dynamic culture of Gujarat during Navratri,” the description of the song on YouTube reads.

Indian batting icon Virat Kohli reached a new milestone in his illustrious career, notching up his 48th century in ODI cricket as India hammered Bangladesh in a World Cup 2023 match. As the cricketing fraternity celebrated Kohli’s new milestone, there were a few who wondered if Kohli slowing down to reach his hundred at the end of the game was the right move. There were moments in the match where his non-striking partner KL Rahul would even deny singles to ensure Kohli get the strike. Veteran India batter Cheteshwar Pujara, however, wasn’t happy with this approach.

“As much I wanted Virat Kohli to score that hundred, you have to keep in mind, you want to finish the game as early as possible. You want your Net Run Rate to be at the top. If you are in a position where you are fighting for the Net Run Rate, then you don’t want to look back and say ‘you could have done that’,” Cheteshwar Pujara told ESPN Cricinfo.

Pujara is of the opinion that Kohli and other Indian players should be putting the tem first. As far as personal milestones, Pujara feels it’s the mindset of the player that also matters.

“That’s where I feel that as a collective decision, maybe you have to sacrifice a bit. You want to look at the team, you want to put the team first, that’s how I look at it. You want your milestone, but not at the cost of the team. As a player, you always have a choice. But some players feel if they get a hundred, it helps them in the next game. So it depends on what kind of mindset you have,” he added.

Australia legend Matthew Hayden also opined on the subject, saying form can bite the player if he starts flirting with it.

“My initial reaction was he has earned the right to get to his hundred. You have got to be very careful in these tournaments. These things matter. The great Ian Bishop often talks about this, these things matter. The sporting gods are sinister-like, if you start flirting with that sort of form, then it can bit you. But it’s a decision that they both took. I don’t really have a problem with that.” Hayden said.
