1. This is a petition filed by the petitioner under Section 439
Cr.P.C. seeking regular bail in case FIR No. 54/2020 under Sections
420
/120B/34 IPC registered at Police Station Budh Vihar District
Rohini Delhi.

2. I have perused the order dated 09.05.2023 passed by this Court
whereby the regular bail application of the present petitioner was
dismissed as withdrawn and it was observed that the charges are yet to
be framed.

3. On my query from the learned APP for the state, whether
charges have been framed or not, the learned APP submitted that the
charges are yet to be framed.

4. Therefore, keeping in view of the fact that the charges have still
not been framed so there is no change in the circumstances since the
dismissal of the previous regular bail application of the petitioner and,
hence no ground for bail is made out at this stage. Accordingly, the
present bail application is dismissed alongwith pending applications,
if any.

5. However, the petitioner is at liberty to file the fresh application
for bail after framing of the charge or as and when fresh ground
arises.
