Manipur violence: The court’s comments are likely to give further ammunition to the Opposition

In scathing remarks against the government over the ethnic violence in Manipur, the Supreme Court said today that there has been an absolute breakdown of constitutional machinery in the state for the past two months.

Terming the investigation “tardy” and “lethargic”, Chief Justice of India DY Chandrachud, who is heading the bench, said there has been a delay in FIRs being registered and statements being recorded. The court has also demanded the personal presence of the Manipur Director General of Police during the next hearing on Monday.

The Supreme Court’s comments are likely to give further ammunition to the Opposition, which has been demanding the removal of Manipur Chief Minister N Biren Singh and the imposition of President’s Rule in the state.

When the hearing began this afternoon, Solicitor General Tushar Mehta informed the court that 6,523 FIRs related to the violence have been registered, and 11 of these pertain to crimes against women and children. He said the data was part of a status report that he is submitting to the court.

Mr Mehta told the bench that seven people, including a juvenile, have been arrested in the case related to the horrific video of the women who were paraded naked and allegedly gang-raped. Justice Chandrachud asked whether the policemen accused of handing over the women to the mob have been interrogated, to which Mr Mehta said it may not be possible to get the information overnight.

The CJI then sought details of another incident in which two women were gang-raped and murdered.

Prefacing his answer with a disclaimer that they had gone through over 6,000 FIRs in one night and there may be some errors in the data, Mr Mehta told the bench that a Zero FIR was registered on May 15 and it was converted into a regular FIR on June 16. When the CJI asked whether any arrests had been made, the Solicitor General said he did not have information on that.

While going through the report submitted by Mr Mehta, the CJI pointed out that an FIR was dated July 26 for an incident that happened on May 4.

“Except for one or two cases, there are no arrests in other cases? The investigation is so lethargic. There has been a delay in filing FIRs, no arrests. For the past two months, has the situation not been conducive for even recording the statements of the victims,” CJI Chandrachud asked.

“The state police is incapable of investigation. They have lost control. There is absolutely no law and order… There has been an absolute breakdown of constitutional machinery in Manipur for the past two months,” an angry Chief Justice said. 

The Solicitor General informed the court that 252 people had been arrested so far in connection with the 6,523 FIRs. He assured the CJI that there won’t be any lethargy on the part of the government and said that the centre was open to transferring all 11 FIRs to the CBI.

“There are about 6,500 cases. We want to see the serious cases. You can’t transfer everything to the CBI. We have to put a mechanism in place,” the CJI said. 

Noting that there have been 150 deaths in Manipur since the violence broke out on May 3,  Justice Chandrachud said that the material provided to the court was inadequate. “State must carry out the exercise of break up of FIRs, how many FIRs concern murder, rape, arson, looting, outraging modesty, destruction of places of religious worship and grievous hurt,” he said

The court then ordered the Director General of Police to be present during the next hearing on Monday and asked him to have the following information ready on each of the FIRs: date of occurrence of incident; date of registration of Zero FIR; date of registration of regular FIR; date on which witness statements were recorded; date on which statements under Section 164 of the Criminal Procedure Code (CrPC) were recorded; and date on which arrests were made.

Justice Chandrachud said the court may think of constituting a committee of former high court judges. “We are just thinking out loud so there are no surprises,” he said.

The court had also posed tough questions to the government during the hearing yesterday. 

“There is no gainsaying the fact that crimes against women are taking place in all parts. You cannot excuse what is taking place in one part of the country, like Manipur, on the ground that similar crimes are happening in other parts too… Are you saying protect all daughters of India or don’t protect anyone,” the CJI had asked when a lawyer had brought up crimes against women in Bengal, Rajasthan and Chhattisgarh.

The issue has led to a logjam in Parliament, with both Houses being repeatedly adjourned since the monsoon session began on July 20.

The procession was stopped by men on the Gurugram-Alwar National Highway near Nuh.

Two Home Guards were shot dead and seven policemen injured as a mob tried to stop a religious procession, throwing stones and setting cars on fire in Haryana. The police used teargas and fired shots in the air to disperse the crowd. Internet services have been suspended in the area and prohibitory orders banning large gatherings have been issued. Later in the evening, a meeting was held between members of two communities to help resolve the situation.

The police have rescued nearly 2,500 men, women and children who had taken shelter at a temple near Nuh, adjoining Gurugram, due to the violence outside. The crowd, stranded at the Nulhar Mahadev temple, had come to take part in the religious procession, during which the violence started.

“Today’s incident is unfortunate, I appeal to all the people to maintain peace in the state. The guilty will not be spared at any cost, strictest action will be taken against them,” Chief Minister Manohar Lal Khattar tweeted.

“There was a meeting between the two communities in Nuh, in which many political and social people were present along with the local administration. A meeting of both the communities will be held again tomorrow at 11:00 am. Meanwhile, Bhiwani SP Shri Narendra Bijarnia has been given additional responsibility of the district. The situation is normal in the district now,” read a rough translation of a tweet by the Haryana Police.

The clash started as the Brij Mandal Jalabhishek Yatra, organised by the Vishwa Hindu Parishad, was stopped by a group of young men on the Gurugram-Alwar National Highway and stones were thrown at the procession.

As the violence escalated, government and private vehicles were targeted by the mob. Towards evening, violence spread to the Gurugram-Sohna highway, where several cars were torched and stones were thrown at the police, sources said. Later, the injured policemen were shifted to the Medanta hospital, where they are receiving treatment.

Reports say the clash was triggered by an objectionable video posted on social media by a Bajrang Dal activist.

Sources said Bajrang Dal member Monu Manesar and his associates – suspects in several criminal cases — had circulated the video a few days ago. He had openly challenged that he would stay in Mewat during the yatra.

Many are claiming to have seen them during the yatra. The locals allegedly retaliated to it.

Schools, colleges and educational institutions in Gurugram and Faridabad districts will remain closed on Tuesday in view of the tension in the area, the Haryana Police have said. The Haryana Board of School Education, Bhiwani, has cancelled the board exams for Classes 10 and 12 due on Tuesday and Wednesday.

In view of the events at Nuh, the Delhi Police have been asked to step up vigilance.

The government is set to introduce a bill in parliament today for control of services and officers’ posting in Delhi, setting up the stage for a showdown with the opposition. The bill was earlier an ordinance.

  1. The Government of National Capital Territory of Delhi (Amendment) Bill has become a rallying point for a united opposition against the BJP-led National Democratic Alliance (NDA).

  2. The draft bill to replace the ordinance for creating an authority for transfers and postings of senior officers in the Delhi government has been circulated among the MPs.

  3. Delhi Chief Minister Arvind Kejriwal’s Aam Aadmi Party (AAP), which is a part of the opposition coalition INDIA, has reacted strongly against the bill. The Congress and other opposition parties have also come out against the bill.

  4. Parliament proceedings have been affected by the opposition’s demand for Prime Minister Narendra Modi to speak on the Manipur ethnic conflict in parliament.

  5. Home Minister Amit Shah has clearly said he was ready to respond to a discussion in parliament on the Manipur matter.

  6. But the opposition turned down Mr Shah’s offer, and moved a no-confidence motion against the government as a last bid to make PM Modi speak on the Manipur violence in parliament.

  7. The opposition is upset over the government’s approach of going ahead with its legislative agenda at a time when the Lok Sabha Speaker has admitted the no-confidence motion.

  8. The government has listed 13 draft legislations for consideration and passing in Lok Sabha even as the notice for moving the no-confidence motion is pending before the house.

  9. Parliamentary Affairs Minister Pralhad Joshi dared the opposition to defeat the government bills in the house if they believe they have the numbers in Lok Sabha. “They have suddenly brought the no-confidence motion. Does that mean no government business should take place? If they have the numbers, they should defeat the bills on the floor of the house,” the minister said on Friday.

  10. Members of the newly formed opposition grouping INDIA, who went to violence-hit Manipur in the past two days, are likely to bring more ammo to attack the Modi government when the house opens today.

Manipur violence: PM’s silence shows “his brazen indifference to the violence in Manipur,” they said.

The 21-member multi-party delegation of MPs of the Opposition’s Indian National Developmental Inclusive Alliance (INDIA) alliance that is in Manipur for a two-day visit to assess the situation in the strife-torn state today met Manipur Governor Anusuiya Uikey and shared their experience. 

In a memorandum submitted to Governor Uikey, they requested her to restore peace and harmony taking all effective measures, “where justice should be the cornerstone”. 

“In order to bring peace and harmony, rehabilitation and resettlement of the affected persons is most urgent. You are also requested to apprise the Union Government of the complete breakdown of law and order in Manipur for the last 89 days so as to enable them to intervene in the precarious situation in Manipur to restore peace and normalcy,” it said. The delegation has visited relief camps at Churachandpur, Moirang, and Imphal, and interacted with the victims/inmates in the relief camps, they said.

The silence of Prime Minister Narendra Modi shows “his brazen indifference to the violence in Manipur,” the memorandum read, citing figures of the destruction in the ethnic conflict that has continued for over three months now.

“The failure of both the Central and state government to protect the lives and properties of the people of the two communities is apparent from the figures of more than 140 deaths, more than 500 injuries, burning of more than 5,000 houses and internal displacement of more than 60,000 people,” it said.

Reports of incessant firing and arson of houses in the last few days establishes, “beyond doubt”, that the state machineries have completely failed to control the situation for the last almost three months, the Opposition’s memorandum to the Governor alleged.

The condition in the relief camps “is pathetic is to say the least,” it said, adding that special care needs to be taken for children on a priority basis. The delegation argued that the continued internet ban for the last three months is aiding the unsubstantiated rumours, which is adding to the existing mistrust.

Rajya Sabha MP Sushmita Dev of the Trinamool Congress, at a press conference, assured the people of the state that the opposition alliance stands with them and will fight till the last day of the Parliament’s monsoon session to “make the Prime Minister accountable” to Manipur.

“Coming from the northeastern states, one has the feeling that people will forget us in the Parliament,” she said, adding that the BJP will accuse the opposition of doing photo-op, disrupting the Parliament, and not wanting to debate the issue.

Congress leader Adhir Ranjan Chowdhury said the Governor herself expressed her sorrow in the meeting. 

“She also advised that we all speaking to all the leaders, be it Kuki or Meitei, of all communities and find a path to a solution. She also advised that an all party delegation should come to Manipur and speak to leaders of all communities because the atmosphere of mistrust that has been created among the people has to be addressed by everyone together,” Mr Chowdhury said.

Sushmita Dev had earlier told PTI that among those they met was one of the two women who was paraded naked and sexually assaulted by a mob in Manipur on May 4, and her mother. The latter had one request for them, Ms Dev said, to help her at least see the bodies of her son and husband, who were killed during the incident.

The BJP has slammed the Opposition MPs and pointed to the alleged crimes against women in Rajasthan and West Bengal. “This is just optics. When this I.N.D.I.A. returns from Manipur, I want to ask Adhir Ranjan Chowdhury if he supports the crimes against women in his state, West Bengal. Will these 20 MPs of I.N.D.I.A. (front) give reports on Rajasthan and West Bengal as well,” asked Union Minister Anurag Thakur.

The government of Chief Minister N Biren Singh, who has thus far refused to give in to demands of resignation, has decided to convene an assembly session at the end of this month or early August. At least 180 people have died and thousands have been displaced since the violence broke out on May 3.

Assam Chief Minister Himanta Biswa Sarma on Friday urged the police to develop a standard operating Procedure (SOP) for probing cases of ‘love-jihad’ in the state.

The root cause of ‘love jihad’ is forceful religious conversions, Mr Sarma claimed in his address to the superintendents of police at a convention in Bongaigaon.

“Besides, an act will be implemented soon in the state through which the marriageable age will be legally fixed for all communities, multiple marriages will be stopped and more legislative steps will be taken so that when arrests are made for violating the norms, the accused do not get bail,” Mr Sarma said.

The chief minister has been claiming that the triple murder case in Golaghat where a 25-year old Muslim man killed his Hindu wife and her parents on Monday was a case of ‘love jihad’, a term used by right-wing groups to allege that Muslim men lure Hindu women to convert through marriage.

He also claimed there have been many tragic incidents of suicide by girls who have been victims of ‘love jihad’.

Mr Sarma had earlier claimed on Thursday that there will be peace in the country if Hindu and Muslim men marry women of their respective communities. The chief minister told the convention that another operation to combat child marriages in the state will be launched in September and legislative backing will be given to ensure prosecution of the accused held for polygamy and child marriages.

Mr Sarma urged all SPs of the state to be prepared for more arrests in September as there will be another round of action against child marriage then.

”Whenever a child marriage comes to our notice we will have to prosecute the accused under POCSO as it is a secular Act and does not deal with any religion,” he said. The POCSO Act applies equally to all citizens of all religions who commit sexual offences against children.

”There are some vintage acts that have come to our notice. We will repeal them as it comes in the way of taking action against child marriage,” he said. Mr Sarma said crime against women in Assam has drastically come down to 14,030 cases in 2022 as against 29,046 cases in 2021, which is much below the annual average of 27,240 cases between 2017-21. Crimes against children in the state have also come down to 4,084 as against 5,282 in previous years.

High profile cases must be tried in special courts, special public prosecutors must be engaged and charge sheets must be filed within the stipulated period to serve as a deterrent in future, he added.
